Common use of Consequences of Termination on Notice by the Province Clause in Contracts

Consequences of Termination on Notice by the Province. If the Province terminates the Agreement pursuant to section A11.1 (Termination on Notice), the Province may take one or more of the following actions: (a) cancel all further instalments of Funds; and (b) demand from the Recipient the payment of any Funds remaining in the possession or under the control of the Recipient.

Consequences of Termination on Notice by the Province. If the Province terminates the Agreement pursuant to section A11.1 A.11.1 (Termination on Notice), the Province may take one or more of the following actions: (a) Direct the Recipient not to incur any further costs for the Project subsequent to the Notice of termination. If the Recipient fails to comply with such direction and unless with the Province’s prior written consent, the Recipient shall be solely responsible for any further costs incurred after such Notice was given; (b) cancel all further instalments of Funds; and (b) demand from the Recipient the payment of any Funds remaining in the possession or under the control of the Recipient.
