CONSEQUENCES OF WITHDRAWAL OR TERMINATION. 14.1 If this Agreement is terminated under clause 13.2 the Participating Operators shall be entitled to a redistribution of revenue calculated in accordance with Schedule 6 in respect of revenue attributable to sales made until cessation of the Scheme.

All Operators who continue to bound by this Agreement agree to publish a notice informing the public of changes to the Operators participating in the Scheme: in the case of withdrawal of an Operator under clause 6.1, within the 28 day notice period; in the case of termination of the Agreement against an Operator under clause 7.1 or termination of the Scheme by agreement under clause 7.3, as soon as reasonably practicable.

  • H4 Consequences of Expiry or Termination H4.1 Where the Authority terminates the Contract under clause F5.5 (Remedies in the Event of Inadequate Performance) or clause H2 (Termination on Default) and then makes other arrangements for the supply of Services, the Authority may recover from the Contractor the cost reasonably incurred of making those other arrangements and any additional expenditure incurred by the Authority throughout the remainder of the Contract Period. The Authority shall take all reasonable steps to mitigate such additional expenditure. Where the Contract is terminated under clause F5.5 or clause H2 (Termination on Default), no further payments shall be payable by the Authority to the Contractor until the Authority has established the final cost of making those other arrangements.

Prior to making a determination that the Applicant has failed to comply in any material respect with the terms of this Agreement or to meet any material obligation under this Agreement, the District shall provide the Applicant with a written notice of the facts which it believes have caused the breach of this Agreement, and if cure is possible, the cure proposed by the District.
