Common use of Construction and Interpretation of This Agreement Clause in Contracts

Construction and Interpretation of This Agreement. 16.1 This Agreement contains the entire agreement between the parties in relation to its subject-matter and supersedes any other agreement between the parties regarding the subject matter hereof. The parties acknowledge that this Agreement has not been entered into wholly or partly in reliance on, nor has either party been given, any warranty, statement, promise or representation other than as expressly set out in this Agreement. The Client irrevocably and unconditionally waives any right it has or may have to claim damages for, and/or to rescind this Agreement because of breach of any warranty not contained in this Agreement, or any misrepresentation whether or not contained in this Agreement, and the Client agrees that the only rights and remedies available to it arising out of or in connection with any warranties, statements, promises or representations will be for breach of contract. Nothing in this sub-Clause shall exclude either party's liability in respect of misrepresentations made fraudulently.
