Common use of Construction Commencement Clause in Contracts

Construction Commencement. Anything in this Agreement to the contrary notwithstanding, Company shall not be obligated to proceed with any construction in connection with the Company Work unless and until all of the following conditions have been satisfied: (i) all Required Approvals for the Company Work have been received, are in form and substance satisfactory to the Parties, have become final and non-appealable and commencement of such construction is permitted under the terms and conditions of such Required Approvals, and (ii) all Company Reimbursable Costs invoiced to date have been paid in full to Company.
