Construction Expenses. Construction Expenses. All costs and expenses of any and all labor, materials, supplies and equipment used in the construction maintenance or repair of the Improvements have been paid in full or to the extent any such costs and expenses have resulted in a Lien against the Property, the Title Insurance Policy provides Lender satisfactory affirmative insurance with respect to such Lien. To Borrower's knowledge after due inquiry, there are no claims for payment for work, labor or materials affecting the Property which are or may become a lien prior to, or of equal priority with, the Liens created by the Loan Documents.
