Common use of CONSTRUCTION OF THE PROJECT/ APARTMENT Clause in Contracts

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, Payment Plan and the specification, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specification, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. 6.1 The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the said Apartment and accepted the floor plan, Payment Plan and the specification, amenities and facilities [annexed along with this Agreement] plan which has been approved by the competent authorityCorporation, as represented by the PromoterTotal Price & payment plan mentioned in 3rd Schedule and the Additional Liabilities and Deposits mentioned in 6th Schedule and the specifications, the Common Areas, amenities and facilities mentioned in 4th & 5th Schedules. The Promoter shall develop the Project said Apartment in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in of this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities Corporation and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Kolkata Municipal Corporation and/or other relevant statutes and shall not have an option to make any variation /alteration / /alteration/modification in such plans, other than in the manner provided under the ActAct and/or allowed by the competent authorities under the relevant statutes and this Agreement, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen and accepted the proposed layout planplan and the floor plan of the Apartment shown in Annexure-A to the Agreement, specifications, amenities and facilities of the Apartment Apartment/Project as mentioned in the Part II of the THIRD SCHEDULE hereto and have accepted the floor plan, Payment Plan and the specification, amenities and facilities [annexed along with this Agreement] same which has been approved by the competent authority, as represented by the PromoterPromoters. The Promoter Promoters shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject to the terms in of this Agreement, the Promoter Promoters undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Rajpur Sonarpur Municipality and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter Promoters shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Allotted Apartment (stated in Part-III of the Third Schedule) and accepted the Payment Plan, floor plan, Payment Plan and the specification, amenities and facilities [plan (annexed along with this Agreement] ), layout plans which has been approved by the competent authority, as represented by Competent Authority. The Allottee has also understood that the PromoterTower in which the Allotted Apartment is situated forms part of the Phase 1B Project. The Promoter shall develop the Phase 1B Project in accordance with the said layout plansplan, floor plans, specification, amenities plan and facilitiesspecifications. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such the plans approved and as may be approved as per the provisions contained herein by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations rules of the concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, Act and the Rules and breach of this term by the Promoter shall constitute a material breach of the Agreement.

Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 as applicable from time to time and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, Act and Rules made there under or as per approval/instructions/guidelines of the competent authorites and any breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities amenities, and facilities of the Apartment [Apartment] and accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in this Agreement, the Promoter promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) RulesSouth 24 Parganas Xxxxx Xxxxxxx, 2020 West Bengal The South 24 Parganas Revised General Bye-Law, 2014 and shall not have an option to make any variation /alteration / alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment LIG/ EWS flat/ Shops & Offices [Apartment/Plot] and accepted the layout plan, floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 [Please insert the relevant State laws] and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities amenities, and facilities of the Apartment [Apartment] and accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in this Agreement, the Promoter promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha New Kolkata Development Authorities Authority (Planning and Building StandardsNKDA) The New Town Kolkata (Building) Rules, 2020 2009 [Please insert the relevant State laws] and shall not have an option to make any variation /alteration / alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment and accepted the Payment Plan, floor planplans, Payment Plan and the specification, amenities and facilities [layout plans (annexed along with this Agreement] ) which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout with the said layout plans, floor plans, specification, amenities plans and facilitiesspecifications. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations |Regulations of concerned Concerned local planning authority - Odisha Development Authorities Planning Authority (Planning and Building Standardsplease insert the relevant State laws) Rules, 2020 and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Designated Apartment and accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with as per relevant Schedules to this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Allottee has also understood that the building in which the Designated Apartment is situated forms part of the first phase of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and facilities, amenities and facilities. Subject specifications, subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Municipal Act and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under the this Agreement and the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has have seen and accepted the proposed layout planplan of the Apartment and also the floor plan as also shown in SECOND SCHEDULE(Floor Plan) to the, specifications, amenities and facilities of the Apartment Apartment/Project as mentioned in the Part-II of the THIRD SCHEDULE hereto and have accepted the floor plan, Payment Plan and the specification, amenities and facilities [annexed along with this Agreement] same which has been approved by the competent authority, as represented by the PromoterPromoters. The Promoter Promoters shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject to the terms in of this Agreement, the Promoter Promoters undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standardsauthority(ies) Rules, 2020 and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter Promoters shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Purchaser/Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, Payment Plan payment plan and the specification, specifications amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter Owner/Vendor No. 2/Developer shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in this Agreement, Agreement the Promoter Owner/Vendor No. 2/Developer undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and KMC Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Rules and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter Owner/Vendor No. 2/Developer shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment Unit and accepted the floor planPayment Plan, Payment Plan and the specificationplans, amenities and facilities layout plans [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Allottee has also understood that the building in which the Unit is situated forms part of the second phase of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specification, amenities plans and facilitiesspecifications. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and any modifications to be hereafter approved by the authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities The New Town Kolkata (Planning and Building StandardsBuilding) Rules, 2020 and 2014and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment Unit and accepted the floor planPayment Plan, Payment Plan and the specificationplans, amenities and facilities layout plans [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Allottee has also understood that the building in which the Unit is situated forms part of the one of the phases of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specification, amenities plans and facilitiesspecifications as mentioned in Part-7 of Schedule A hereto. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and any modifications to be hereafter approved by the authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Kolkata Municipal Corporation Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Rules and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

The Promoter shall develop the Project said Apartment in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in of this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities Corporation and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 Kolkata Municipal Corporation and/or other relevant statutes and shall not have an option to make any variation /alteration / /alteration/modification in such plans, other than in the manner provided under the ActAct and/or allowed by the competent authorities under the relevant statutes and this Agreement, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed theproposed layout plan, specifications, amenities and facilities of the Apartment [Apartment/Plot/unit] and accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. Promoterwhich was duly verified by the allottee after making its due diligence.. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 and [Please insert the relevant State laws]and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment Residential Cum Commercial Plot [Apartment/Residential Cum Commercial Plot] and accepted the layout plan, floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 [Please insert the relevant State laws] and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee Allottee/Purchaser has seen the proposed layout plan, specifications, amenities and facilities of the Apartment Flat/Apartment/Unit and accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the PromoterPROMOTER/DEVELOPER. The Promoter PROMOTER/DEVELOPER shall develop the Project in accordance with the said layout plans, floor plans, specificationplans and specifications, amenities and facilities. Subject , subject to the terms in this Agreement, the Promoter PROMOTER/DEVELOPER undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Planning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 2020 [Please insert the relevant State laws] and shall not have an option to make any variation /alteration / variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter PROMOTER/DEVELOPER shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Allotted Apartment and has accepted the floor plan, Payment Plan payment plan and the specificationspecifications, amenities and facilities [annexed along with this Agreement] (stated in Part-I and Part-II of the Third Schedule hereunder written) which has been approved by the competent authorityCompetent Authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plansplan, floor plans, specificationplan and specifications, amenities and facilities.
