CONSTRUCTION AND RENOVATION. Construction and renovation projects for a state, local, territorial, or Tribal government’s principal Emergency Operations Center (EOC) as defined by the State Administrative Agency are allowable under the EMPG Program. Written approval must be provided by FEMA prior to the use of any EMPG Program funds for construction or renovation. Requests for EMPG Program funds for construction of an EOC must be accompanied by an EOC Investment Justification (located in the Related Documents tab of the EMPG xxxxxx.xxx posting) to their Regional EMPG Manager for review. Additionally, recipients are required to submit a SF-424C Form and Budget detail citing the project costs. When applying for funds to construct communication towers Sub-Recipients must submit evidence that the Federal Communication Commission’s (FCC) Section 106 review process has been completed and submit all documentation resulting from that review to Grants Program Directorate (GPD) prior to submitting materials for EHP review. Sub-Recipients are also encouraged to have completed as many steps as possible for a successful EHP review in support of their proposal for funding (e.g., coordination with their State Historic Preservation Office to identify potential historic preservation issues and to discuss the potential for project effects, compliance with all state and EHP laws and requirements). Projects for which the Sub-Recipient believes an Environmental Assessment (EA) may be needed, as defined in as defined in DHS Instruction Manual 023-01-001-01, Revision 01, FEMA Directive 108-1 and FEMA Instruction 108-1-1, must also be identified to the FEMA EMPG Regional Program Manager within six months of the award, and completed EHP review materials must be submitted no later than 12 months before the end of the period of performance. EHP review packets should be sent to xxxxxxxxxx@xxxx.xxx. EMPG Program Sub-Recipients using funds for construction projects must comply with the Xxxxx-Xxxxx Act (40 U.S.C. §§ 3141 et seq.). Grant Sub-Recipients must ensure that their contractors or subcontractors for construction projects pay workers no less than the prevailing wages for laborers and mechanics employed on projects of a character similar to the contract work in the civil subdivision of the state in which the work is to be performed. Work is generally scheduled during normal daytime hours (7:00 a.m. – 5:00 p.m.). Construction projects could result in disturbances and disruptions, including but not limited to, increased noise and dust in the area. University Housing will provide notification of construction in or near student apartments whenever possible. By accepting this Agreement, the Licensee agrees that they have been advised of possible construction and acknowledges disturbances and disruptions resulting from construction are not grounds for termination of this agreement or adjustment in housing charges.

Major construction projects in and around the vicinity of the UC San Diego campus are scheduled throughout the year, including local governments' Light Rail Transit (LRT) construction projects, and new construction, remodeling or repair of UCSD academic, residential and dining facilities. Construction activities are expected to occur during normal daytime working hours, and will result in disturbances and disruptions, including, but not limited to, increased traffic, noise and dust in the areas surrounding the apartments, residence halls, and campus in general. There will be both planned and unplanned utility shutdowns in the apartments and residence halls. By signing this Contract, Xxxxxxx agrees and acknowledges that there will be disturbances and disruptions resulting from construction, and has agreed to such.

Construction and/or remodeling or repair of academic and residential buildings on the USF campus may occur during the academic year and may result in disturbances and disruptions including (but not limited to) increased noise and dust in the area surrounding the residence halls and both planned and unplanned utility shutdowns in the residence halls. By signing this Contract, the student agrees that he or she has been advised of possible construction and acknowledges that there may be disturbances and disruptions resulting from such construction, and has agreed to such.
CONSTRUCTION AND RENOVATION. Capital improvement and other major construction or repair projects will necessarily cause increased noise, inconvenience, and dust in affected and nearby residences at certain times. By signing this agreement, the STUDENT acknowledges advisement of the possibility of increased noise and dust during such projects and that such reasonable disruptions are not grounds for termination of this Housing Agreement.

Requests for EMPA Program funds for construction of an EOC must be accompanied by a justification to their EMPA Grant Manager for review and processing. The above examples are not intended to exclude other construction projects as potentially allowable costs. For example, construction of a facility for the storage of critical emergency supplies, as a Point of Distribution (POD) for emergency distribution, and/or to serve as a staging area for deployment of emergency response resources is potentially an allowable expense. Other construction or renovation projects, such as a secondary or local EOC, will be considered on a case-by-case basis, with advance written approval.

Capital improvement and other major housing construction or repair projects will necessarily cause increased noise and dust in affected and nearby residences at certain times. There is the possibility of both planned and unplanned utility shutdowns and access to certain facilities, streets, parking lots, walking, and bike pathways may be limited, rerouted, or completely restricted. The University will work with building contractors to make every effort to minimize construction inconveniences. By agreeing to this Agreement, the Resident acknowledges notice of the possibility of scheduled construction and access limitations, and acknowledges that there will be disturbances, disruptions, and inconveniences resulting from such constructions and has agreed to such. The Resident also acknowledges that increased noise, dust, potential reassignment, or loss of parking spaces related to construction or renovation are not grounds for cancellation or termination of this Agreement.

By signing this License Agreement, the Licensee agrees that they have been advised of possible construction and acknowledges that disturbances and disruptions resulting from construction are not grounds for termination of this License Agreement or for an adjustment in room costs.

Construction is expected to occur during normal daytime working hours, but will result in disturbances and disruptions, including, but not limited to, increased noise and dust in the area surrounding the Residence Halls and planned and unplanned utility shutdowns in the Residence Halls. By signing this contract, the Student agrees they have been advised of said scheduled construction, acknowledges there will be disturbances and disruptions resulting from such construction and agrees to such disturbances and disruptions.

Housing will provide timely notification of construction in or near residence halls whenever possible. By signing this License Agreement, the Licensee agrees that they have been advised of possible construction and acknowledges disturbances and disruptions resulting from construction are not grounds for termination of this agreement or adjustment in the License Fee.
