Common use of Consultations by CDFG Clause in Contracts

Consultations by CDFG. Except as otherwise required by law, CDFG shall not recommend or otherwise seek to impose through consultation with other public agencies any mitigation, compensation or habitat enhancement requirements regarding impacts of Covered Activities on Covered Species within the Permit Area that are in excess of those that have been or will be required by this Agreement, the HCP/NCCP, and the Permits.

Consultations by CDFG. Except as otherwise required by law, CDFG shall not recommend or otherwise seek to impose through consultation with other public agencies any mitigation, compensation or habitat enhancement requirements regarding impacts of Covered Activities on RPV Covered Species within the Permit Area Subarea that are in excess of those that have been or will be required by the requirements prescribed in and pursuant to the RPV NCCP Subarea Plan and this Agreement, the HCP/NCCP, and the Permits.

Consultations by CDFG. Except as otherwise required by law, CDFG shall not recommend or otherwise seek to impose through consultation with other public agencies any mitigation, compensation or habitat enhancement requirements regarding impacts of Covered Activities on to Covered Species within that exceed the Permit Area that are requirements prescribed in excess of those that have been or will be required by and pursuant to the MSHCP and this Agreement, including, without limitation, in the HCP/NCCP, and form of comments offered by CDFG in the Permitscontext of any CEQA process associated with approvals for Covered Activities with regard to effects on Covered Species.
