Common use of Contingency Provision Clause in Contracts

Contingency Provision. In the event this grant is terminated for any reason, the CARB Executive Officer or designee reserves the right in his or her sole discretion to award a grant to the next highest scored applicant and if an agreement cannot be reached, to the next applicant(s) until an agreement is reached. If CARB is unable to award a grant under these circumstances, CARB may award a grant in a manner consistent with direction provided in the FY 2018-19 Funding Plan for Diesel Filter Replacement Program for Disadvantaged Communities2.

Contingency Provision.
