CONTINGENT FUNDING. 13 a. Any obligation of COUNTY under this Agreement is contingent upon the following: 14 1) The continued availability of federal, state and county funds for reimbursement of 15 COUNTY’s expenditures, and 16 2) Inclusion of sufficient funding for the services hereunder in the applicable budget 17 approved by the Board of Supervisors. 18 b. In the event such funding is subsequently reduced or terminated, COUNTY may 19 terminate or renegotiate this Agreement upon one hundred twenty (120) calendar day written notice 20 given CONTRACTOR. COUNTY agrees to provide CONTRACTOR reasonable notice of any changes 21 in funding and to pay CONTRACTOR for any ongoing work being performed by CONTRACTOR 22 through to a reasonable point of termination.
