Common use of Continuance of Work During Dispute Clause in Contracts

Continuance of Work During Dispute. At all times during the term of this Contract, including during the course of and notwithstanding the existence of any Claim: (a) Contractor shall perform as directed by Owner, in a diligent manner and without delay, shall abide by Owner’s decisions or orders, and shall comply with all applicable provisions of the Contract Documents; and (b) Owner shall perform its obligations under this Contract in a diligent manner and without delay. Records of the Work shall be kept in sufficient detail to enable payment in accordance with applicable provisions in the Contract Documents.

Continuance of Work During Dispute. At all times during the term course of this Contract, including the dispute resolution process and during the course of and notwithstanding the existence of any Claim: (a) litigation, Contractor shall perform continue with the Work as directed by Ownerdirected, in a diligent manner and without delay, shall abide by or conform to Owner’s decisions 's decision or ordersorder, and shall comply with be governed by all applicable provisions of the Contract Documents; and (b) Owner shall perform its obligations under this Contract in a diligent manner and without delay. Records of the Work shall be kept in sufficient detail to enable payment in accordance with applicable provisions in the Contract DocumentsContract.

Records keep records of the Work shall be kept in sufficient detail to enable payment in accordance with applicable provisions in this Contract irrespective of the Contract Documentsultimate outcome of any dispute.
