Common use of Continuation of Agreement Clause in Contracts

Continuation of Agreement. Termination as the result of any cause listed in Section 5 shall not affect the Fund's obligation to furnish its shares to Contracts then in force for which its shares serve or may serve as the underlying medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body, or is determined by the Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereof.

Continuation of Agreement. Termination as the result of any cause listed in Section 5 6 shall not affect the Fund's obligation to furnish its shares to Contracts then in force for which its shares serve or may serve as the underlying medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body, or is determined by the Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereof.

Termination as the result of any cause listed in Section 5 shall not affect the Fund's obligation to furnish shares of its shares Series to Contracts then in force for which its such shares serve or may serve as the underlying medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body, or is determined by the Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereof.

Termination as the result of any cause listed in Section 5 shall not affect the Fund's Funds’ obligation to furnish its shares to Contracts Policies then in force for which its such shares serve or may serve as the underlying investment medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body, or is determined by the Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereof.

Continuation of Agreement. Termination as the result of any cause listed in Section 5 6 shall not affect the Fund's ’s obligation to furnish its shares to Contracts then in force for which its shares serve or may serve as the underlying medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body; however, or Distributor’s obligation to pay the fees to Aetna as described in Section 3 here& shall terminate if the applicable Fund’s 12b-1 Plan is determined by the Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereofterminated.

Continuation of Agreement. 4 Termination as the result of any cause listed in Section 5 6 shall not affect the Fund's obligation to furnish its shares to Contracts then in force for which its shares serve or may serve as the underlying medium unless such further sale of Fund shares is prohibited by law or the SEC or other regulatory body; however, or is determined by Distributor's obligation to pay the fees to Aetna as described in Section 3 hereof shall terminate if the applicable Fund's Board to be necessary to remedy or eliminate an irreconcilable conflict pursuant to Section 10 hereof12b-1 Plan is terminated.
