Common use of Continuation of Elections Clause in Contracts

Continuation of Elections. Effective as of the Distribution Date, SpinCo (acting directly or through one or more members of the SpinCo Group) shall cause the SpinCo Sales Executives Plan to recognize and maintain all existing elections, including, but not limited to, investment and payment form elections, beneficiary designations, and the rights of alternate payees under qualified domestic relations orders with respect to SpinCo Sales Executives Plan Participants under the RemainCo Sales Executives Plan, to the extent such election or designation is available under the SpinCo Sales Executives Plan.

Continuation of Elections. Effective as of the Distribution Date, SpinCo (acting directly or through one or more members a member of the SpinCo Group) shall cause the SpinCo Sales Executives Pension Plan to recognize and maintain all existing elections, including, but not limited to, investment and payment form elections, beneficiary designations, payment form elections and the rights of alternate payees under qualified domestic relations orders with respect to SpinCo Sales Executives Pension Plan Participants under the RemainCo Sales Executives Plan, to the extent such election or designation is available under the SpinCo Sales Executives Pension Plan.

Effective as of the Distribution Date, SpinCo (acting directly or through one or more members of the SpinCo Group) shall cause the SpinCo Sales Executives Savings Plan to recognize and maintain all existing elections, including, but not limited to, investment deferral, investment, and payment form elections, beneficiary designations, and the rights of alternate payees under qualified domestic relations orders with respect to SpinCo Sales Executives Savings Plan Participants under the RemainCo Sales Executives Savings Plan, to the extent such election or designation is available under the SpinCo Sales Executives Savings Plan.

Continuation of Elections. Effective as As of the Distribution Date, SpinCo (acting directly or through one or more members a member of the SpinCo Group) shall cause the SpinCo Sales Executives Plan SERP to recognize and maintain all existing elections (including deferral, distribution and investment elections, including, but not limited to, investment ) and payment form elections, beneficiary designations, and the rights of alternate payees under qualified domestic relations orders designations with respect to SpinCo Sales Executives Plan Participants under the RemainCo Sales Executives Plan, SERP to the extent such election elections or designation is designations are available under the SpinCo Sales Executives PlanSERP until a new election that by its terms supersedes such original election is made by the SpinCo Participant in accordance with applicable law and the terms and conditions of the SpinCo SERP.

Effective as As of the Distribution DateTime, SpinCo Spinco (acting directly or through one or more members of the SpinCo Groupan Affiliate) shall cause the SpinCo Sales Executives Spinco Supplemental Benefit Plan to recognize and maintain all existing elections (including deferral, distribution and investment elections, including, but not limited to, investment ) and payment form elections, beneficiary designations, and the rights of alternate payees under qualified domestic relations orders designations with respect to SpinCo Sales Executives Plan Spinco Participants under the RemainCo Sales Executives Plan, Quanex Supplemental Benefit Plan to the extent such election elections or designation is designations are available under the SpinCo Sales Executives Spinco Supplemental Benefit Plan until a new election that by its terms supersedes such original election is made by the Spinco Participant in accordance with applicable law and the terms and conditions of the Spinco Supplemental Benefit Plan.

Effective as As of the Distribution DateTime, SpinCo Spinco (acting directly or through one or more members of the SpinCo Groupits Affiliates) shall cause the SpinCo Sales Executives Plan Spinco Welfare Plans to recognize and maintain all existing electionselections and designations (including all coverage and contribution elections and beneficiary designations) made by Spinco Participants under, including, but not limited or with respect to, investment the Quanex Welfare Plans and payment form elections, beneficiary designations, apply such elections and the rights of alternate payees under qualified domestic relations orders with respect to SpinCo Sales Executives Plan Participants designations under the RemainCo Sales Executives PlanSpinco Welfare Plans for the remainder of the period or periods for which such elections or designations are by their original terms applicable, to the extent such election or designation is available under the SpinCo Sales Executives corresponding Spinco Welfare Plan.

Effective as As of the Distribution DateTime, SpinCo Spinco (acting directly or through one or more members of the SpinCo Groupan Affiliate) shall cause the SpinCo Sales Executives Spinco Supplemental Pension Plan to recognize and maintain all existing elections (including deferral, distribution and investment elections, including, but not limited to, investment ) and payment form elections, beneficiary designations, and the rights of alternate payees under qualified domestic relations orders designations with respect to SpinCo Sales Executives Plan Spinco Participants under the RemainCo Sales Executives Plan, Quanex Supplemental Pension Plan to the extent such election elections or designation is designations are available under the SpinCo Sales Executives Spinco Supplemental Pension Plan until a new election that by its terms supersedes such original election is made by the Spinco Participant in accordance with applicable law and the terms and conditions of the Spinco Supplemental Pension Plan.
