Common use of Continuity and Suspension of Service Clause in Contracts

Continuity and Suspension of Service. Each Party shall exercise reasonable care and foresight to maintain continuity of service as provided in the 1992 Agreement. In no event shall one Party be liable to the other Party or its customers for loss or damage arising from failure to provide or for the interruption or suspension of any service provided for herein. Each Party reserves the right to suspend service without liability at such times and for such periods and in such manner as it deems advisable, including, without limitation, suspensions for the purpose of making necessary adjustments to, changes in, or repairs on, its facilities and to suspend service in cases where, in its sole opinion, the continuance of service to the other Party would endanger persons or property. Both Parties shall use their best efforts to provide each other with reasonable notice in the event of suspension of service.
