All labor, equipment, tools, etc., needed to complete contracted projects are to be provided by the Operator. Any fence damage must be repaired within 24 hours at the Operator’s expense. Deer fence integrity must be maintained by closing gates promptly after entry and exit. Timber Damages – when in the opinion of Field Contract Coordinator, damage to the residual stand becomes excessive, the Operator shall pay the Commission a fair base current value determined by the Field Contract Coordinator per unit of volume. If this value for damage due to Operator’s carelessness or negligence is less than $10.00 per tree, then a minimum charge of $10.00 per tree will be made whether the tree is commercial, non-commercial, merchantable, or non-merchantable. Comprehensive General Liability Insurance, including bodily injury and property damage insurance, to protect the Commonwealth and the contractor from claims arising out of the performance of the contract. The amount of bodily injury insurance shall not be less than $300,000.00 for injury to or death of persons per occurrence. The amount of Property Damage Insurance shall not be less than $300,000.00 per occurrence. Such policies shall name the Commonwealth as an additional insured. Prior to the commencement of work under this contract, the contractor must provide the Commonwealth with current Certificates of Insurance. These Certificates shall contain a provision that coverages afforded under the policy shall not be canceled or changed until at least thirty (30) days prior written notice has been given to the Commonwealth. The Commonwealth shall be under no obligation to obtain such certificates from the Operator(s). CONTRACT REQUIREMENTS. All buckthorn, black birch, striped maple and American Beechbeech stems from 5 feet tall to 6 inches DBH must be felled, Sweet Birchwith the following exceptions: All trees marked with purple paint are reserved regardless of diameter. The boundaries for brush cutting project are painted with a single purple band, encompassing a total of 227 acres. The eastern boundary of the cutting area coincides with the State Game Land boundary, which is marked with white paint. There is a Seneca gas pipeline that runs just east of the State Game Land boundary. Care must be taken not to drop debris along the white State Game Land Boundary or the pipeline, and Striped Mapleto keep all equipment off the pipeline. Within the painted area are 32 acres worth of sections which contain extremely dense buckthorn. These areas are indicated on the project map and will be observable in the field as old clearcut blocks with very few mature trees. They were not delineated with paint in the field but are indicated to express the wide range of variability in the number of stems per acre that will be encountered in the project. Please note that there are large tops and debris remaining in these sections of the project area from when whole trees were cut and left lay for grouse habitat in 1996, greater than 10 feet tall must be felled unless it is marked as reserved and they are grown up with RED paintxxxxx bushes and buckthorn, making movement on foot very difficult in places. CONTRACT REQUIREMENTS. In both Blocks, crop trees are marked in red paint. All American Beechcrown-touching competitors of these crop trees are to be cut. Trees to cut are unmarked. All reserve trees from the previous timber harvest and conifers are reserved. No branches from adjacent trees should remain above or touching the branches of the crop trees. When standing below each crop tree, Sweet Birch, a ring of sky should be visible when looking upwards.
