Common use of Contracting Body's Obligations Clause in Contracts

Contracting Body's Obligations. Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: a) states the Services Requirements; b) states the Statement of Work submitted by the successful Framework Supplier; c) states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates the Call-Off Terms applicable to the Services; 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 develop a may: adopt criteria set out in paragraph 2 of Schedule 6 (Award Criteria) when developing its Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 Services Requirements; or invite tenders by conducting a further-further competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 below4) is to be held the Contracting Body shall notify the Framework Suppliers relevant suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if 8. If an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite : Invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's ’s Statement of Requirements ("a ”Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. set supplier; Set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. keep and Keep each tender confidential until the time limit agreed by the Parties has expired; apply the criteria set out in paragraph 3.1.3.(b)(ii2 of Schedule 6 (Award Criteria) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 6 which: a) : states the Services Requirements; b) ; states the Statement statement of Work work submitted by the successful Framework Supplier; c) ; speed of available response, (including, without limitation, capacity to meet required deadlines and, where relevant, geographical location); quality (including expertise, and proposed methods of undertaking the work); states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 ; provide unsuccessful Framework Suppliers suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Available Goods and Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Available Goods and Services and identify the Framework Suppliers capable of supplying the Available Goods and Services; 3.1.2 notify the Framework Suppliers as to which form of Call-Off Agreement (from the list set out in paragraph 6.1 below) will apply to its Goods and Services Requirements; 3.1.3 refine the Call-Off Terms to reflect its Service Goods and Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 3.1.4 invite tenders by conducting a further-competition for its Service Goods and Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. (c) keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.4(b) above has expired.; 3.1.4 3.1.5 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Goods and Services Requirements; 3.1.5 3.1.6 on the basis set out above, award its Goods and Services Requirements by placing an Order entering into a Call-Off Agreement with the successful Framework Supplier in accordance with paragraph 7 6 which: (a) states the Goods and Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges price payable for the Goods and Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Goods and Services; 3.1.6 3.1.7 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.;

Any Contracting Body ordering the Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements Specification statement setting out its requirements for the Services and identify the Framework Suppliers Providers capable of supplying the ServicesServices to be delivered; 3.1.2 refine the Call-Off Terms to reflect its Service Requirements requirements for Services only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Requirements requirements for Services in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, : the Contracting Body shall: i. (i) invite the Framework Suppliers Providers to develop a proposed statement Statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") requirements for Services and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative representative of each Framework SupplierProvider; (ii. ) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and (iii. ) keep each tender confidential unopened until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3 (ii) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' Providers’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirementsrequirements for Services; 3.1.5 on the basis set out above, award its requirements for Services Requirements by placing an Order with the successful Framework Supplier Provider in accordance with paragraph 7 6 which: (a) states the Services Requirementsrequirements for Services; (b) states the Statement of Work work submitted by the successful Framework SupplierProvider; (c) states the charges payable for the requirements for Services Requirements in accordance with the tender submitted by the successful Framework SupplierProvider; and (d) incorporates the Call-Off Terms applicable to the Services;Services to be delivered, 3.1.6 provide unsuccessful Framework Suppliers Providers with a feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Goods and Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Available Goods and Services and identify the Framework Suppliers capable of supplying the Available Goods and Services; 3.1.2 refine the Call-Off Terms to reflect its Service Goods and Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Goods and Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. (b) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. (c) keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3(b) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Goods and Services Requirements; 3.1.5 on the basis set out above, award its Goods and Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 8 which: (a) states the Goods and Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges payable for the Goods and Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Goods and Services;, 3.1.6 provide unsuccessful Framework Suppliers with a feedback debrief in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services Goods and/or Services, including Service Levels and Performance Monitoring, and identify the Framework Suppliers capable of supplying the Goods and/or Services; 3.1.2 ; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Service Goods and/or Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Goods and/or Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 72 below) is to be held the Contracting Body shall notify the Framework Suppliers identified in accordance with paragraph 71.1.1 and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 72.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 71.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Goods and/or Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 75 which Call Off Agreement shall: state the Goods and/or Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Goods and/or Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 71.1.2 above) applicable to the Goods and/or Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 67 below) is to be held the Contracting Body shall notify the Framework Suppliers and identified in accordance with paragraph 66.1.1and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 67.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 66.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 70 which Call Off Agreement shall: state the Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 66.1.2 above) applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; amend or refine the Call-Template Order Form and Template Call Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by issuing the Order Form and Call Off Terms to the Framework Suppliers identified pursuant to paragraph 3.1.1; and conducting a further-competition Further Competition Procedure for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 68 below) is to be held the Contracting Body shall notify the Framework Suppliers and identified in accordance with paragraph 67.1.1and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 68.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 67.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 71 which Call Off Agreement shall: state the Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Order Form and Call Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) : if an Electronic Reverse Auction is not used, the Contracting Body shall: i. :] invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3.1(ii) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 6 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Available Services; 3.1.2 refine the Call-Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. (i) invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative representative of each Framework Supplier; (ii. ) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and (iii. ) keep each tender confidential unopened until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3 (a)(ii) above has expired (b) if lawful to do so, and if an Electronic Reverse Auction (as defined in paragraph 4.1 below) is to be held the Contracting Body shall in its invitation to tender notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract Agreement for its Services Requirements; 3.1.5 on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: (a) states the Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Services;, 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Goods and Services under this Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Goods and Services and identify the Framework Suppliers capable of supplying the Goods and Services; 3.1.2 refine the Call-Off Terms to reflect its Service Goods and Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Goods and Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; (b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. in all circumstances within the Further Competition documentation Contracting Bodies should ask for alternative and more cost effective solutions which may be submitted alongside the proposed Statement of Work. iii. set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iiiiv. keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3(b)(iii) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Goods and Services Requirements; 3.1.5 on the basis set out above, award its Goods and Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: (a) states the Goods and Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges payable for the Goods and Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Goods and Services;, 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful. The substance and form of the feedback given to unsuccessful bidders in the further competition will be at the Contracting Body’s discretion.

Contracting Body's Obligations. Any Contracting Body ordering Services under the Services under this Framework Agreement through a further competition shall: 3.1.1 is expected to:- develop a Statement of Requirements setting out its requirements for the Services and identify the Services Framework Suppliers Service Providers capable of supplying performing the Services; 3.1.2 ; refine the Call-Off Terms and Conditions to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. particular:- invite the Services Framework Suppliers Service Providers to develop a proposed statement of work setting out their respective its proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative Account Manager of each Service Framework Supplier; ii. Service Provider; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.2(b) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Services Framework Suppliers' Service Providers’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Service Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Services Framework Supplier Service Provider in accordance with paragraph 7 which: a) 6 which:- states the Services Requirements; b) ; states the Statement of Work submitted by the successful Services Framework Supplier; c) Service Provider; states the charges price payable for the Services Requirements in accordance with the tender submitted by the successful Services Framework SupplierService Provider; and d) and incorporates the Call-Off Terms and Conditions applicable to the Services; 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Available Services; 3.1.2 refine the Call-Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if lawful to do so, and if an Electronic Reverse Auction (as defined in paragraph 4 4.1 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.34; (b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. (i) invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative representative of each Framework Supplier; (ii. ) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and (iii. ) keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3 (b)(ii) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract Agreement for its Services Requirements; 3.1.5 on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: (a) states the Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Services;, 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Goods and/or Services and identify the Framework Suppliers capable of supplying the Goods and/or Services; 3.1.2 ; amend or refine the Call-Call Off Form and Call Off Terms and/or Lease Agreement to reflect its Service Goods and/or Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Goods and/or Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 72 below) is to be held the Contracting Body shall notify the Framework Suppliers identified in accordance with paragraph 71.1.1 and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 72.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 71.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Goods and/or Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 75 which Call Off Agreement shall: state the Goods and/or Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Goods and/or Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Call Off Form and Call Off Terms and/or Lease Agreement terms (as may be amended or refined by the Contracting Body in accordance with paragraph 71.1.2 above) applicable to the Goods and/or Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Available Services under this the Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Available Services and identify the Framework Suppliers capable of supplying the Available Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 4.2 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) 3; if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3 (b)(ii) above has expired. 3.1.4 expired apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 5.1.3 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) ; if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 21 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements Services Requirement setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; conduct market engagement with the Framework Suppliers to ensure that Framework Suppliers understand the Services Requirement and to refine this further prior to commencing a further-competition; refine the Call-Off Terms to reflect its Service Requirements Services Requirement only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements Requirement in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 3 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) 3.4 ; if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") Services Requirement and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii2.1.4 .(b)(ii) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 Requirement; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 6 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers identified in accordance with paragraph 61.1.1 and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 62.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 61.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 65 which Call Off Agreement shall: state the Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 61.1.2 above) applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Goods and Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Available Goods and Services and identify the Framework Suppliers capable of supplying the Available Goods and Services; 3.1.2 refine the Call-Off Terms to reflect its Service Goods and Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a further-competition for its Service Goods and Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. (b) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. (c) keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3(b) above has expired. 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Goods and Services Requirements; 3.1.5 on the basis set out above, award its Goods and Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 8 which: (a) states the Goods and Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges payable for the Goods and Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Goods and Services; 3.1.6 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.,

Contracting Body's Obligations. Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 : develop a a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) : [if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) ; if an Electronic Reverse Auction is not used, the Contracting Body shall: i. :] invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 15 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 65 below) is to be held the Contracting Body shall notify the Framework Suppliers identified in accordance with paragraph 64.1.1 and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 65.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 64.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 68 which Call Off Agreement shall: state the Services Requirements; b) states ; state the Statement of Work tender submitted by the successful Framework Supplier; c) states ; state the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 64.1.2 above) applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition Further Competition Procedure shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services Goods and/or Services, including Service Levels and Performance Monitoring, and identify the Framework Suppliers capable of supplying the Goods and/or Services; 3.1.2 ; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Service Goods and/or Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition Further Competition Procedure for its Service Goods and/or Services Requirements in accordance with the Regulations and Guidance and in particular: a) : if an Electronic Reverse Auction (as defined in paragraph 4 62 below) is to be held the Contracting Body shall notify the Framework Suppliers and identified in accordance with paragraph 61.1.1and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; b) 62.3; or if an Electronic Reverse Auction is not used, the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals identified in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers accordance with paragraph 61.1.1 to submit a tender in writing for each specific contract proposed Call Off Agreement to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract proposed Call Off Agreement and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above for the return of tenders has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Contract Agreement for its Goods and/or Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which: a) states 65 which Call Off Agreement shall: state the Goods and/or Services Requirements; b) states and/or Services Requirements (including level of licence required for the Statement of Work Supplier software); state the tender submitted by the successful Framework Supplier; c) states ; state the charges Charges payable for the Goods and/or Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) incorporates and incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 61.1.2 above) applicable to the Goods and/or Services; 3.1.6 , provide unsuccessful Framework Suppliers with a written feedback in relation to the reasons why their tenders were unsuccessful.

Any Contracting Body ordering the Services under this Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) : [if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) ; if an Electronic Reverse Auction is not used, the Contracting Body shall: i. :] invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 16 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Goods and Services under this the Framework Agreement through a further competition shall: 3.1.1 is expected to:- develop a Statement of Requirements setting out its requirements for the provision of the Goods and Services and identify the Framework Suppliers Providers capable of supplying performing the provision of the Goods and Services; 3.1.2 ; refine the Call-Off Terms and Conditions to reflect its Service Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Requirements in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. particular:- invite the Framework Suppliers Providers to develop a proposed statement of work setting out their respective its proposals in respect of such Contracting Body's Statement of Requirements ("“Statement of Work"”) and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative Account Manager of each Framework Supplier; ii. Provider; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii3.1.2(b) above has expired. 3.1.4 . apply the Further Competition Award Criteria to the Framework Suppliers' Providers’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier Provider in accordance with paragraph 7 which: a) 6 which:- states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) Provider; states the charges price payable for the Services Requirements in accordance with the tender submitted by the successful Framework SupplierProvider; and d) and incorporates the Call-Off Terms and Conditions applicable to the provision of the Goods and Services; 3.1.6 . The Provider will in writing, by the time and date specified by the Contracting Body in accordance with Clause 31.1.3(b), provide unsuccessful Framework Suppliers the Contracting Body with either:- a feedback statement to the effect that it does not wish to tender in relation to the reasons why their relevant Requirements; or the Statement of Work and full details of its tender made in respect of the relevant Statement of Requirements. In the event that the Provider submits a Statement of Work, it should include, as a minimum:- an email response subject line to comprise unique reference number and Provider name, so as to clearly identify the Provider; a brief summary, in the email, stating whether or not the Provider is bidding for the Statement of Requirements; a proposal covering the Requirements. confirmation of discounts applicable to the work, as referenced in Schedule 3 The Provider shall ensure that any prices submitted in relation to a further competition held pursuant to this paragraph 3 shall be based on the Charges and take into account any discount to which the Contracting Body may be entitled as set out in Schedule 3. The Provider agrees that all tenders were unsuccessfulsubmitted by the Provider in relation to a further competition held pursuant to this paragraph 3 shall remain open for acceptance for thirty (30) days (or such other period specified in the invitation to tender issued by the relevant Contracting Body in accordance with the Ordering Procedure).

Contracting Body's Obligations. Any Contracting Body ordering the Services under this the Framework Agreement through a further competition shall: 3.1.1 : develop a Statement of Requirements setting out its requirements for the Services and identify the Framework Suppliers capable of supplying the Available Services; 3.1.2 ; refine the Call-Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 ; invite tenders by conducting a further-competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4.3; b) if an Electronic Reverse Auction is not used, : the Contracting Body shall: i. : invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative representative of each Framework Supplier; ii. ; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and iii. and keep each tender confidential unopened until the time limit set out in paragraph 3.1.3.(b)(ii3.1.3 (a)(ii) above has expired. 3.1.4 expired if lawful to do so, and if an Electronic Reverse Auction (as defined in paragraph 4.1 below) is to be held the Contracting Body shall in its invitation to tender notify the Framework Suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 4. apply the Further Competition Award Criteria to the Framework Suppliers' ’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Contract Agreement for its Services Requirements; 3.1.5 ; on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: a) : states the Services Requirements; b) ; states the Statement of Work submitted by the successful Framework Supplier; c) ; states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and d) and incorporates the Call-Off Terms applicable to the Services; 3.1.6 , provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations. Any Contracting Body ordering the Available Services under this the Framework Agreement through a further competition shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Available Services and identify the Framework Suppliers capable of supplying the Available Services; 3.1.2 refine the Call-Off Terms to reflect its Service Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 refine the Baseline Criteria specified in Framework Schedule 3 to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.4 invite tenders by conducting a further-competition Further Competition for its Service Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 4.1 below) is to be held the Contracting Body shall notify the Framework Suppliers and shall conduct the further competition Further Competition in accordance with the procedures set out in paragraph 4.34; (b) if an Electronic Reverse Auction is not used, the Contracting Body shall: i. (i) invite the Framework Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body's Statement of Requirements ("Statement of Work") and invite the Framework Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework Supplier; (ii. ) set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and (iii. ) keep each tender confidential until the time limit set out in paragraph 3.1.3.(b)(ii) above 3.1.4(b)(ii)above has expired. 3.1.4 3.1.5 apply the Further Competition Award Criteria to the Framework Suppliers' Suppliers‟ compliant tenders submitted through the further competition Further Competition as the basis of its decision to award a Call-Off Contract for its Services Requirements; 3.1.5 3.1.6 on the basis set out above, award its Services Requirements by placing an Order with the successful Framework Supplier in accordance with paragraph 7 which: (a) states the Services Requirements; (b) states the Statement of Work submitted by the successful Framework Supplier; (c) states the charges price payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporates the Call-Off Terms applicable to the Ordered Services;; and 3.1.6 3.1.7 provide unsuccessful Framework Suppliers with a feedback in relation to the reasons why their tenders were unsuccessful.
