Common use of CONTRACTOR/CONSTRUCTION INFORMATION Clause in Contracts

CONTRACTOR/CONSTRUCTION INFORMATION. Borrower shall deliver to Lender in a form acceptable to Lender: (a) a list detailing the name, address and phone number of each contractor, subcontractor and material supplier to be employed or used for construction of the Improvements who is under contract or otherwise has been selected to supply goods or services or perform work for the Project costing in excess of $5,000 in the aggregate and any other person or entity who delivers a Preliminary Notice to Owner or Lender under Civil Code Sections 3097 or 3098 (collectively, "Principal Subs") together with the dollar amount, including changes, if any, reflected in each contract and subcontract for the Principal Subs, and the portion thereof, if any, paid through the date of such list of Principle Subs; (b) copies of each contract and subcontract identified in such list of Principal Subs, including any changes thereto; (c) a cost breakdown of the projected total cost of constructing the Improvements, and that portion, if any, of each cost item which has been incurred; and (d) a construction progress schedule detailing the progress of construction and the projected sequencing and completion time for uncompleted work, all as of the date of such schedule. Borrower agrees that Lender's approval of any contractor, subcontractor or material supplier if and to the extent permitted under the terms of this Agreement shall not constitute a warranty or representation of qualification by Lender. Lender may contact any contractor, subcontractor or material supplier to discuss the course of construction.

Within ten (10) days of Lender’s written request, Borrower shall deliver to Lender from time to time in a form reasonably acceptable to Lender: (a) a list detailing the name, address and phone number of each contractor, subcontractor and material supplier to be employed or used for construction of the Renovation Improvements who is under contract or otherwise has been selected to supply goods or services or perform work for the Project costing in excess of $5,000 in the aggregate and any other person or entity who delivers a Preliminary Notice to Owner or Lender under Civil Code Sections 3097 or 3098 (collectively, "Principal Subs") together with the dollar amount, including changes, if any, reflected in of each contract and subcontract for the Principal Subssubcontract, and the portion thereof, if any, paid through the date of such list of Principle Subslist; (b) copies of each contract and subcontract identified in such list of Principal Subslist, including any changes thereto; (c) a cost breakdown of the projected total cost of constructing the Renovation Improvements, and that portion, if any, of each cost item which has been incurred; and (d) a construction progress schedule detailing the progress of construction and the projected sequencing and completion time for uncompleted work, all as of the date of such schedule. Borrower agrees that Lender's approval of Lender may disapprove any contractor, subcontractor or material supplier if which, in Lender’s good faith determination, is deemed financially or otherwise unqualified; provided, however, that Lender shall not unreasonably disapprove any contractor, subcontractor or material supplier for which Borrower has obtained contractor default insurance; and to further provided, however, that the extent permitted under the terms absence of this Agreement any such disapproval shall not constitute a warranty or representation of qualification by Lender. Lender may contact any such contractor, subcontractor or material supplier to discuss the course of construction, upon Lender’s request Borrower shall coordinate a meeting among Borrower, Lender and such contractor, subcontractor or material supplier for such purpose.

Administrative Agent or any Lender may contact any such contractor, subcontractor or material supplier to discuss the course of construction.
