Common use of CONTRACTOR/CONSTRUCTION INFORMATION Clause in Contracts

CONTRACTOR/CONSTRUCTION INFORMATION. Within ten (10) Business Days of Administrative Agent’s written request, Borrower shall deliver to Administrative Agent from time to time in a form reasonably acceptable to Administrative Agent: (a) a list detailing the name, address and phone number of each contractor, subcontractor and material supplier to be employed or used for construction of the Improvements together with the dollar amount, including changes, if any, of each contract and subcontract, and the portion thereof, if any, paid through the date of such list; (b) copies of each contract and subcontract identified in such list, including any changes thereto; (c) a cost breakdown of the projected total cost of constructing the Improvements, and that portion, if any, of each cost item which has been incurred; and (d) a construction progress schedule detailing the progress of construction and the projected sequencing and completion time for uncompleted work, all as of the date of such schedule. Borrower agrees that Administrative Agent may disapprove any contractor, subcontractor or material supplier if a material and reasonable basis exists to deem such contractor, subcontractor or material supplier financially or otherwise unqualified; provided, however, that the absence of any such disapproval shall not constitute a warranty or representation of qualification by Administrative Agent or any Lender. Administrative Agent or any Lender may contact any such contractor, subcontractor or material supplier to discuss the course of construction.
