Common use of Contractor to Keep all Property Free and Clear of Liens Clause in Contracts

Contractor to Keep all Property Free and Clear of Liens. Contractor shall at all times promptly pay for all services, materials, equipment and labor used or furnished by Contractor in the performance of the Work under the Contract and shall at its expense keep all property belonging to Owner free and clear of any and all of the above-mentioned liens and rights of lien arising out of services, labor, equipment or materials furnished by Contractor or its employees, materialmen, Suppliers, Subcontractors or Sub-subcontractors in the performance of the Work. If Contractor fails to release and discharge any such claim of lien against Owner's premises or the property of Owner arising out of performance of the Work within five (5) working days after receipt of written notice from Owner or Owner’s Representative to remove such claim of lien, Owner may, at its option, discharge or release the claim of lien or otherwise deal with the lien claimant, and Contractor shall pay Owner any and all costs and expenses of Owner in so doing, including reasonable attorney's fees incurred by Owner.
