The Contractor's Documents shall comprise the technical documents specified in the Contract Awarder's Requirements, documents required to satisfy all regulatory approvals, and the documents described in Sub-Clause 5.6 [As-Built Documents' and Sub-Clause 5.7 [Operation and Maintenance Manuals]. Unless otherwise stated in the Contract Awarder's Requirements, the Contractor's Documents shall be written in the language for communications defined in SubClause 1.4 [Law and Language]. Contractor’s Documents. The Contractor's Documents shall comprise Contractor must provide to the technical Subcontractor the documents and number of copies of those documents specified in the Contract Awarder's RequirementsSubcontract Particulars. Subcontractor’s Design The Subcontractor must: design the parts of the Subcontract Works which the Subcontract requires it to design in accordance with the Subcontract Works Description, documents required to satisfy all regulatory approvals, the Preliminary Design Solution and the documents described in Sub-Clause 5.6 [As-Built Documents' other requirements of the Subcontract and Sub-Clause 5.7 [Operation and Maintenance Manuals]. Unless otherwise stated in for this purpose (but without limitation) prepare all relevant Design Documentation; as part of the Contract Awarder's Requirementsprogram it is to prepare under clause 10.2, submit to the Contractor's Documents shall be written in ’s Representative for approval a documentation program which makes allowance for the language for communications defined in SubClause 1.4 [Law and Language]. The Contractor shall prepare all Contractor's Documents, and shall also prepare any other documents necessary to instruct the Contractor's Personnel. If the Contract Awarder's Requirements describe the Contractor's Documents which are Design Documentation to be submitted to the Contract Awarder for review, they shall be submitted accordingly, together with Contractor’s Representative in a notice as described below. In manner and at a rate which will give the following provisions of this Sub-Clause, (i) "Contractor’s Representative a reasonable opportunity to review period" means the Design Documentation within the period required by the Contract Awarder for review, and (ii) "Contractor's Documents" exclude any documents which are not specified as being required to be submitted for review. Unless otherwise stated in the Contract Awarder's Requirements, each review period shall not exceed 21 days, calculated from the date on of time within which the Contract Awarder receives a Contractor's Document ’s Representative may review the Design Documentation under clause 6.3; and submit the Design Documentation it prepares to the Contractor's notice. This notice shall state that the Contractor's Document is considered ready, both for review in accordance with this Sub-Clause and for use. The notice shall also state that the Contractor's Document complies with the Contract, or the extent to which it does not comply. The Contract Awarder may, within the review period, give notice to the Contractor that a Contractor's Document fails (to the extent stated) to comply with the Contract. If a Contractor's Document so fails to comply, it shall be rectified, resubmitted and reviewed in accordance with this SubClause, at the Contractor's cost. For each part of the Works, and except to the extent that the Parties otherwise agree:
(a) execution of such part of the Works shall not commence prior to the expiry of the review periods for all the Contractor's Documents which are relevant to its design (ISBL) and execution;
(b) execution of such part of the Works shall be in accordance with these Contractor's Documents, as submitted for review; and
(c) if the Contractor wishes to modify any ISBL Design or document which has previously been submitted for review, the Contractor shall immediately give notice to the Contract Awarder. Thereafter, the Contractor shall submit revised documents to the Contract Awarder ’s Representative in accordance with the above proceduredocumentation program approved by the Contractor’s Representative under paragraph (b). Any such agreement (under the preceding paragraph) The Contractor’s Representative may: review any Design Documentation, or any resubmitted Design Documentation, prepared and submitted by the Subcontractor; and within the number of days specified in the Subcontract Particulars of the submission by the Subcontractor of such Design Documentation or resubmitted Design Documentation, reject the Design Documentation if in the Contractor’s Representative’s reasonable opinion the Design Documentation does not comply with the requirements of the Subcontract. If any Design Documentation is rejected, the Subcontractor must submit amended Design Documentation to the Contractor’s Representative. The Subcontractor must not commence construction of any part of the Subcontract Works to which any Design Documentation it has submitted to the Contractor’s Representative applies, unless the Contractor’s Representative has had the number of days specified in the Subcontract Particulars to review (under this Sub-Clause or otherwise) shall the Design Documentation and has not relieve rejected the Contractor from any obligation or responsibilityDesign Documentation.
