Contractual Liens Sample Clauses
A Contractual Liens clause establishes the right of one party to claim a security interest in specific property or assets as collateral for the performance of contractual obligations. In practice, this means that if a party fails to fulfill its obligations, such as payment or delivery of goods, the other party may enforce the lien to recover losses, often by retaining or selling the secured property. This clause serves to protect the interests of the party granting credit or services by providing a legal mechanism to secure repayment or performance, thereby reducing the risk of non-payment or breach.
