Contribution to Satisfaction of Conditions. With respect to the environmental mitigation and the wheeling condition above and in § 4.2(c), the Authority may (but is not in any way compelled to) contribute the additional costs, in excess of the specified caps, such that the net economic effect to the IID is the same as if the condition had been satisfied directly. (See examples and methodology description in Exhibit J.) In that event, the condition is deemed satisfied, and the IID may not terminate the Agreement on the basis that the condition has not been satisfied. The Authority's right applies both before and after the Effective Date.

  • Satisfaction of Conditions The conditions precedent set out in Section 6.1, Section 6.2 and Section 6.3 shall be conclusively deemed to have been satisfied, waived or released at the Effective Time.
