Common use of Converting to One Break per Day Clause in Contracts

Converting to One Break per Day. Applicable to Monday to Friday work only. Clause 36.1, clause 36.2, clause 36.4 and clause 36.5 shall not apply to an employee that is working in accordance with clause 36.6. 36.6.1 If only one (1) break is taken, employees will work in accordance with one (1) of the examples below or hours agreed between the employer and the employee that are similar to those provided in the examples. Employee Starts Work at 6.00 am. Between 10.00 am and 10.30 (paid break). Employee Ceases Work at 1.45 pm.‌‌‌ Overtime would be payable from 1.45 pm. Employee Starts Work at 6.30 am. Between 10.30 am and 11.00 (paid break). Employee Ceases Work at 2.15 pm.‌‌‌ Overtime would be payable from 2.15 pm. Employee Starts Work at 7.00 am. Between 11.00 am and 11.30 (paid break). Employee Ceases Work at 2.45 pm.‌‌ Overtime would be payable from 2.45 pm. 36.6.2 An employee will be paid and accrue entitlements as if they had worked an eight (8) hour day. 36.6.3 The paid one break shall be a duration of 30 (thirty) minutes.
