Copies; Signatures. The Borrower hereby expressly acknowledges and agrees that (i) this Agreement and all other agreements and documents of any kind in the Bank’s possession which may now or hereafter be furnished, made, executed and/or delivered by the Borrower (including, without limitation, any and all Loan Documents), and/or which may otherwise relate to all or any part of the Obligations, may be reproduced by the Bank by photographic, computer imaging or similar process, and the Bank may destroy the original from which any documents was so reproduced; (ii) any such reproduction shall be admissible in evidence as the original itself in any judicial or administrative proceeding (whether or not the original is in existence and whether or not such reproduction was made in the regular course of business) and any enlargement, facsimile or further reproduction shall likewise be admissible in evidence; and (iii) any signature of the Borrower upon any such agreement or document which is transmitted as a facsimile or as a scanned document or image (including, without limitation, in any “.pdf”, “.jpg”, “.tiff”, “.bmp”, “.png”, “.gif” and/or any other electronically-formatted image and/or document) shall be deemed a valid and binding signature of the Borrower with the same effect as if a manually signed original signature of the Borrower.

Copies; Signatures. A fully executed facsimile or electronic copy of this Agreement shall be treated as an original Agreement and signatures may be made in counterparts to the Agreement.

  • Facsimile and Email Signatures The use of facsimile signatures and signatures delivered by email in portable document format (.pdf) affixed in the name and on behalf of the transfer agent and registrar of the Partnership on certificates representing Common Units is expressly permitted by this Agreement.
