Common use of COVENANT AGAINST CONTINGENT FEES Clause in Contracts

COVENANT AGAINST CONTINGENT FEES. Contractor warrants that it has not employed or retained any company or person, other than a bona fide employee working for Contractor, to solicit or secure this Agreement, and that it has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making this agreement. For breach or violation of this warranty, the County shall have the right to annul this agreement without liability, or in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.

COVENANT AGAINST CONTINGENT FEES. Contractor warrants Consultant warrants, by execution of this Agreement that it no person or selling agency has not employed been employed, or retained any company or person, other than a bona fide employee working for Contractorretained, to solicit or secure this Agreementcontract upon an agreement or understanding, and that it has not paid or agreed to pay any company or person, other than for a bona fide employee, any fee, commission, percentage, brokerage brokerage, or contingent fee, giftexcepting bona fide employees, or any other consideration, contingent upon bona fide established commercial or resulting from selling agencies maintained by Consultant for the award or making this agreementpurpose of securing business. For breach or violation of this warranty, the County shall have has the right to annul this agreement contract without liability; pay only for the value of the work actually performed, or in its discretion to deduct from the agreement contract price or consideration, or otherwise recover, recover the full amount of such fee, commission, percentage, brokerage feebrokerage, gift or contingent fee.

The Contractor warrants that this it has not employed or retained any company or company, person, other than a bona fide employee working solely for the Contractor, to solicit or secure this Agreement, and that it has not paid or agreed to pay any company or person, other than a bona fide employee, for any fee, commission, percentage, brokerage fee, giftgifts, or any other consideration, contingent upon or resulting from the award or making of this agreementcontract. For breach or violation of this warranty, the County Board shall have the right to annul this agreement Contract without liability, liability or in its discretion to deduct from the agreement Contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.

For breach or violation of this warranty, the County shall have the right to annul this agreement without liability, or in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.

COVENANT AGAINST CONTINGENT FEES. The Contractor warrants that it no person or selling agency has not been employed or retained any company or person, other than a bona fide employee working for Contractor, to solicit or secure this Agreement, and that it has not paid Price Agreement upon an agreement or agreed to pay any company or person, other than understanding for a bona fide employee, any fee, commission, percentage, brokerage brokerage, or contingent fee, gift, excepting bona fide employees or any other consideration, contingent upon bona fide established commercial or resulting from selling agencies maintained by the award or making this agreementContractor for the purpose of securing business. For breach or violation of this warranty, the County shall have the right to annul terminate this agreement without liabilityPrice Agreement in accordance with the termination clause and, or in at its discretion sole discretion, to deduct from the agreement Price Agreement‟s price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage feebrokerage, gift or contingent feefee from the Contractor.

Contractor Attorney warrants that it has not employed or retained any company or person, other than a bona fide employee working for ContractorAttorney, to solicit or secure this Agreement, and that it has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making this agreementAgreement. For breach or violation of this warranty, the County shall have the right to annul this agreement Agreement without liability, or in its discretion to deduct from the agreement Agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift gift, or contingent fee.

For breach or violation of this warranty, the County shall have the right to annul this agreement without liability, or in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.

For breach or violation of this warranty, the County shall have the right to annul this agreement without liability, or in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.

Contractor CONSULTANT warrants that it he/she has not employed or retained any company or person, other than a bona fide employee working for Contractorthe consultant, to solicit or secure this Agreement, and that it he/she has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making formation of this agreement. For breach or violation of this warranty, the County VCTC shall have the right to annul this agreement Agreement without liability, liability or in at its discretion to deduct from the agreement Agreement price or consideration, or otherwise recover, recover the full amount of such fee, commission, percentage, brokerage fee, gift gift, or contingent contingency fee.

COVENANT AGAINST CONTINGENT FEES. Contractor Operator warrants that it has not employed or retained any company or person, other than a bona fide employee working for ContractorOperator, to solicit or secure this Agreement, and that it has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making this agreement. For breach or violation of this warranty, the County shall have the right to annul this agreement without liability, or in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.
