Coverage B: Employer’s Liability Coverage. A. How This Coverage Applies. This workers' compensation Coverage Agreement applies to bodily injury by accident or bodily injury by disease. Bodily injury includes resulting death. (1) The bodily injury must arise out of or in the course of the injured employee’s employment by the Member. (2) The employment must be necessary or incidental to the Member’s work and in workplaces identified by the coverage documents. (3) Bodily injury by accident must occur during the policy period. (4) Bodily injury by disease must be caused or aggravated by the conditions of the Member’s employment. The employee’s last day of last exposure to the conditions causing or aggravating such bodily injury by disease must occur during the coverage period. (5) If the Member is sued, the original suit and any related legal actions for damages for bodily injury by accident or by disease must be brought in the United States of America, its territories or possessions, or Canada. B. The Trust Will Pay. Subject to the applicable limits of liability (as stated on the Coverage Declarations Page), the Trust will pay all sums the Member legally must pay as damages because of bodily injury to the Member’s employees, provided the bodily injury is covered by this Employer’s Liability Coverage Agreement. The damages the Trust will pay, where recovery is permitted by law, include damages: (1) For which the Member is liable to a third party by reason of a claim or suit against the Member by that third party to recover the damages claimed against such third party as a result of injury to the Member’s employee; (2) For care and loss of services; and (3) For consequential bodily injury to a spouse, child, parent, brother or sister of the injured employee; provided that these damages are the direct consequence of bodily injury that arises out of and in the course of the injured employee’s employment by the Member; and (4) Because of bodily injury to the Member’s employee that arises out of and in the course of employment, claimed against the Member in a capacity other than as employer.

  • Workers’ Compensation and Employer’s Liability Coverage The insurer shall agree to waive all rights of subrogation against the City, its directors, officials, officers, employees, agents and volunteers for losses paid under the terms of the insurance policy which arise from work performed by the Consultant.

Such policies shall cover all employees engaged in any work under the Grant.

  • Employer’s Liability It is expressly agreed and understood that the Employer does not accept, nor is the Employer to be charged hereby with, any responsibility in any manner connected with the determination of liability to any employee claiming under any of the benefits extended by the Health and Welfare Fund.   • Automobile Liability Coverage Consultant shall maintain automobile liability insurance covering bodily injury and property damage for all activities of the Consultant arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired and non- owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.

  • Excess Liability Insurance $___________________ minimum required insurance policy for anything other than General Liability or Automobile coverage. ☐ - Additional Insurance Requirement: Client, Contractor, and any other entity which the Contractor is required to name as an additional insured under the Prime Contract shall be named as additional insureds under the General Liability Insurance required by this Section and any such insurance afforded to the additional insureds shall apply as primary insurance. Any other insurance maintained by the Client or Contractor shall be excess insurance and shall not be called upon to contribute to Subcontractor’s primary or excess insurance carrier’s duty to defend or indemnify unless required by law. The excess insurance required above shall also afford additional insured protection to Client and Contractor. This Section shall in no event be construed to require that additional insured insurance coverage be provided to a greater extent than permitted under the statutes or public policy governed under State law. Certificates of Insurance. Certificates of insurance, and the required additional insured and other endorsements, including waivers of subrogation shall be furnished to Contractor before the performance of any Services.
