Common use of COVID-19 Vaccination Requirement Clause in Contracts

COVID-19 Vaccination Requirement. (dated September 27, 2021); Has developed a COVID-19 Vaccination Verification Plan for Contractor’s personnel (including subcontractors) that complies with the above-referenced Proclamation; Has obtained a copy or visually observed proof of full vaccination against COVID-19 for Contractor personnel (including subcontractors) who are subject to the vaccination requirement in the above-referenced Proclamation; Complies with the requirements for granting disability and religious accommodations for Contractor personnel (including subcontractors) who are subject to the vaccination requirement in the above-referenced Proclamation; Has operational procedures in place to ensure that any contract activities that occur on-site at Washington state agency premises or at the premises of any Purchaser who so requests (other than only for a short period of time during a given day and where any moments of close proximity to others on-site will be fleeting – e.g., a few minutes for deliveries) that are performed by Contractor personnel (including subcontractors) will be performed by personnel who are fully vaccinated or properly excepted or exempted as required by the above-referenced Proclamation; Has operational procedures in place to enable Contractor personnel (including subcontractors) who perform contract activities on-site at Washington state agency premises or at the premises of any Purchaser who so requests to provide compliance documentation that such personnel are in compliance with the above-referenced Proclamation; and Will provide to Enterprise Services or Purchaser, upon request, Contractor’s COVID-19 Vaccination Verification Plan and related records, except as prohibited by law, and will cooperate with any investigation or inquiry pertaining to the same.

Clear Roads Qualified Product List (QPL). Contractor represents and warrants, as previously certified in Contractor’s Bidder’s Certification, that Contractor shall provide only snow and ice control products that comply with the latest Clear Roads Qualified Products List (QPL) with the exception that all liquid deicer shall pass through a 20 MESH screen at zero (0) degrees Fahrenheit. Contractor further represents and warrants that, during the term of this Contract, Contractor shall maintain approved status on the QPL.

Investigator License. Contractor represents and warrants that the Investigators have a Private Investigator License issued by the state of Washington, per RCW 18.165 and WAC 308.17. Collective Bargaining Agreement. Contractor represents and warrants that the Investigators fully understands and will comply with the rights employees have under any relevant collective bargaining agreement when providing services on this Contract. Civil Service Rules. Contractor represents and warrants that the Investigators fully understands and will apply the civil service rules that apply to all non represented employees and employers under the jurisdiction of Chapter 41.06 RCW except those positions or employees exempted under the provisions of Chapter 357-04 WAC when providing services on this Contract. HR Directives. Contractor represents and warrants that the Investigators fully understands and will comply with all relevant Washington HR directives when providing services on this Contract.
