Common use of CREW AND EQUIPMENT Clause in Contracts

CREW AND EQUIPMENT. The Provider will furnish an adequate sized crew capable of performing the work in a safe and timely manner. The Provider will furnish all equipment, tools, and machinery for the proper prosecution of the work. The equipment will be on the work site in good operating condition, will have all manufacturers’ safety features in proper working condition prior to beginning work, and will remain in place during the prosecution of work. Initially or during the performance of work, any equipment found to be defective, and such defect, in the opinion of the State, that will potentially affect the quality of work, will be immediately repaired or replaced. The State will furnish mulch, replacement plants, and replacement shrubs/trees.
