Common use of Crew’s Effects Clause in Contracts

Crew’s Effects. 18.1 When any seafarer suffers total or partial loss of, or damage to, their personal effects whilst serving on board the ship as a result of wreck, loss stranding or abandonment of the vessel, or as a result of fire, flooding or collision, excluding any loss or damage caused by the seafarer’s own fault or through theft or misappropriation, they shall be entitled to receive from the Company compensation up to a maximum specified in APPENDIX 3.

When any seafarer a Seafarer suffers total or partial loss of, or damage to, their his personal effects effects, due to whatever cause, either whilst serving on board the ship as a result of wreckVessel or traveling to and from the Vessel (if it is not theft, loss stranding or abandonment of lose trough his fault, if it is not the vesselcarrier’s responsibility), or as a result of fire, flooding or collision, excluding any loss or damage caused by the seafarer’s own fault or through theft or misappropriation, they he shall be entitled entitle to receive recover from the Company compensation up to a maximum specified in APPENDIX 3the sum of _3000_ USD.

When any seafarer Seafarer suffers total or partial loss of, or damage to, their his personal effects effects, either whilst serving on board the ship as a result of wreckShip or traveling to and from the Ship on Owners/Company business, loss stranding or abandonment of the vessel, or as a result of fire, flooding or collision, excluding any loss or damage caused by the seafarer’s own fault or through theft or misappropriation, they he shall be entitled to receive recover from the Owners/Company compensation up to a maximum specified in APPENDIX 3the Schedule of Cash Benefits, Annex 2 of this document. The Seafarer shall certify that any information provided with regard to lost property is true to the best of his knowledge.

Crew’s Effects. 18.1 14.1 When any seafarer Employee suffers total or partial loss of, or damage to, their his/her personal effects whilst serving on board the ship vessel as a result of wreck, loss stranding or abandonment of the vesselloss, or as a result of stranding, abandonment, fire, flooding or collisioncollision of the vessel, excluding any loss or damage caused by the seafarerEmployee’s own fault or through theft or misappropriation, they he/she shall be entitled to receive from compensation in accordance with the Company compensation up to a maximum specified in APPENDIX 3Flag State legislation.

When any seafarer suffers total or partial loss of, or damage to, to their personal effects whilst serving on board the ship as a result of wreck, loss stranding or abandonment of the vessel, or as a result of fire, flooding or collision, collision excluding any loss or damage caused by the seafarer’s seafarers own fault or through theft or misappropriation, misappropriation they shall be entitled to receive from the Company compensation up to a maximum specified in APPENDIX 3of US$ 3,300/-, which includes cash upto US$ 330/-.
