Cumulative Remedies; Non-Waiver. Except as otherwise expressly set forth in this Agreement, the termination provisions of this Article 7 are in addition to any other relief and remedies available to either Party. Waiver by any Party of a single default or breach or a succession of defaults or breaches shall not deprive such Party of any right to terminate this Agreement or seek damages arising by reason of any subsequent default or breach.

Cumulative Remedies; Non-Waiver. The Buyer’s rights and remedies contained herein are cumulative and in addition to any other remedies at law or equity. The acceptance by such Sublessor of any Monthly Maintenance Fees, Supplemental Maintenance Fees, Ground Rent or other sums to be paid hereunder shall not be a waiver of any preceding breach or default by a Condominium Sublessee of any provision hereof, other than the failure of such Sublessee to pay the particular Monthly Maintenance Fees, Supplemental Maintenance Fees, Ground Rent, or other sum accepted, regardless of Sublessor’s knowledge of such preceding breach or default at the time of acceptance of such Monthly Maintenance Fees, Supplemental Maintenance Fees, Ground Rent, or other sum, or a waiver of Sublessor’s right to exercise any remedy available to Sublessor by virtue of such breach or default.
Cumulative Remedies; Non-Waiver. Neither party’s receipt of any payment with or without the knowledge of any breach of any covenant hereof, shall not be deemed as waiver of such breach and no waiver of any sum or right hereunder shall be valid unless made in writing and signed by the party waiving said sum or right. No delay or omission in the exercise of any right or remedy accruing to PIA upon any breach by the Registrant of any of the obligation provided in this Agreement shall impair such right or remedy or be construed as a waiver of any such breach thereafter occurring.

All rights, powers, options or remedies afforded to Lessor either hereunder or by law shall be cumulative and not alternative and the exercise of one right, power, option or remedy shall not bar other rights, powers, options or remedies allowed hereto or by law.
Cumulative Remedies; Non-Waiver. (a) Except as otherwise specifically provided in this Agreement, the rights, powers, authorities, remedies, interests and benefits conferred upon the Agent and the Lenders by and as provided in this Agreement are intended to supplement, and be in addition to (and shall not in any way otherwise replace, supersede, amend, limit or restrict), the rights, powers, authorities, remedies, interests, and benefits conferred by the Credit Agreement and the Loan Documents.

Notwithstanding anything to the contrary contained herein or in any other Loan Document, the authority to enforce rights and remedies hereunder and under the other Loan Documents against the Loan Parties or any of them shall be vested exclusively in, and all actions and proceedings at law in connection with such enforcement shall be instituted and maintained exclusively by, the Administrative Agent in accordance with Section 8.02 for the benefit of all the Lenders and the L/C Issuer; provided, however, that the foregoing shall not prohibit (a) the Administrative Agent from exercising on its own behalf the rights and remedies that inure to its benefit (solely in its capacity as Administrative Agent) hereunder and under the other Loan Documents, (b) the L/C Issuer or the Swing Line Lender from exercising the rights and remedies that inure to its benefit (solely in its capacity as L/C Issuer or Swing Line Lender, as the case may be) hereunder and under the other Loan Documents, (c) any Lender from exercising setoff rights in accordance with Section 10.08 (subject to the terms of Section 2.13), or (d) any Lender from filing proofs of claim or appearing and filing pleadings on its own behalf during the pendency of a proceeding relative to any Loan Party under any Debtor Relief Law; and provided, further, that if at any time there is no Person acting as Administrative Agent hereunder and under the other Loan Documents, then (i) the Required Lenders shall have the rights otherwise ascribed to the Administrative Agent pursuant to Section 8.02 and (ii) in addition to the matters set forth in clauses (b), (c) and (d) of the preceding proviso and subject to Section 2.13, any Lender may, with the consent of the Required Lenders, enforce any rights and remedies available to it and as authorized by the Required Lenders.
