Curable Breach. If Grantor determines that a breach by Xxxxxxx is curable, Grantor may send written notice to Grantee stating the nature of the breach. Should the breach not be cured by Grantee within thirty days from the date of the notice, the Agreement will be immediately terminated. Forbearance of this section or any other termination provision by Grantor shall not constitute a waiver of the breach.
Curable Breach. Distributor’s breach of Section 15(b) or any subsection of Section 15(c) other than Section 15(c)(i), if remaining uncured twenty (20) days after written notice from Supplier, shall constitute a breach of this Agreement. In the event of Distributor’s breach of Section 15(b) or any subsection of Section 15(c) other than Section 15(c)(i) remains uncured after such period, Distributor shall have the remedies set forth in Section 15(d)(iv).
Curable Breach. In any event of failure of performance by DISTRIBUTOR, COMPANY must give DISTRIBUTOR ten (10) business days written notice within which DISTRIBUTOR may cure DISTRIBUTOR's failure of performance. If DISTRIBUTOR does not cure such failure of performance within this ten (10) day period, COMPANY may thereafter terminate this Agreement and DISTRIBUTOR shall have no further right to cure. Furthermore, the parties agree that repeated violations, even if cured, constitute a chronic failure of performance and threaten substantial harm to COMPANY's business, trademarks or reputation, and in such event COMPANY shall be entitled to terminate this Agreement immediately and DISTRIBUTOR shall have no further right to cure.
Curable Breach. If CalPERS determines that the breach or violation is curable, CalPERS will provide an opportunity for the Business Associate to cure the breach or end the violation within a reasonable time period set by CalPERS, not to exceed ninety (90) days. If the breach or violation is not cured or ended within the time set by CalPERS, CalPERS may (i) immediately terminate this BAA and any Other Agreement; or (ii) suspend perf ormance by CalPERS under the Other Agreement until such breach or violation is cured or ended.
Curable Breach. If prior to referring the issue to dispute resolution in accordance with this clause, CNI and FCF can agree on a method and period within which such failure is to be cured, and FCF fails to cure such failure according to the method and within the period agreed, then CNI may terminate this agreement by notice to FCF in writing and this agreement will terminate ten (10) Business Days from the date of such notice.
Curable Breach. If prior to referring the issue to dispute resolution in accordance with this clause UBS Mangakahia and the Manager can agree on a method and period within which such failure is to be cured, and the Manager fails to cure such failure according to the method and within the period agreed, then UBS Mangakahia may terminate this agreement by notice to the Manager in writing and this agreement will terminate 10 Business Days from the date of such notice.
Curable Breach. If prior to referring the issue to dispute resolution in accordance with this clause CNI and the Manager can agree on a method and period within which such failure is to be cured, and the Manager fails to cure such failure according to the method and within the period agreed, then CNI may terminate this agreement by notice to the Manager in writing and this agreement will terminate 10 Business Days from the date of such notice.
Curable Breach. Jobber by act or omission breaches or defaults on any covenant, condition or other provision of this agreement, which breach or default can be cured, and Jobber fails to cure such breach or default within ten (10) days after such written notice from ChevronTexaco which shall specify such breach or default; or
Curable Breach. If prior to referring the issue to dispute resolution in accordance with this clause, UBS Mangakahia and FCF can agree on a method and period within which such failure is to be cured, and FCF fails to cure such failure according to the method and within the period agreed, then UBS Mangakahia may terminate this agreement by notice to FCF in writing and this agreement will terminate ten (10) Business Days from the date of such notice.
