Current Address of Payee. The Plan Administrator has no obligation to locate any person entitled to payments hereunder and will be fully protected if all payments, notices and other papers are mailed to the last address of which such person has notified the Plan Administrator in writing, or are withheld pending receipt of proof of his current address and proof that he is alive.

Current Address of Payee. The plan administrator shall make reasonable efforts to locate any participant, beneficiary, or alternate payee to whom benefits are required to be paid under the terms of the plan or applicable law. If, as a result of the exercise of reasonable efforts to locate any such person, the plan administrator is unable to locate such person, the plan administrator shall dispose of such person's account balance in the manner specified in the adoption agreement. If disposition of any person's account balance under any one or more of the methods described in this section is impracticable or would adversely affect the qualification of the plan, the plan administrator may substitute any other reasonable method, in its sole discretion, which is consistent with the qualification requirements of Subchapter D of the Code. If a benefit is forfeited because the Participant or beneficiary cannot be found, such benefit will be reinstated if a claim is made by the Participant or beneficiary.
Current Address of Payee. Any person entitled to benefits is responsible for keeping Amoco informed of his current address at all times. The Plan Administrator, the Trustee and Amoco have no obligation to locate such person, and will be fully protected if all payments and communications are mailed to his last known address, or are withheld pending receipt of proof of his current address and proof that he is alive. If payments are withheld and after reasonable efforts, the Plan Administrator or Amoco cannot locate a former Participant (or Beneficiary) within a reasonable time, but in any event not later than 4 years, the amount of the Participant's Accounts shall be forfeited and shall be reapplied in such a way as to reduce succeeding Company Matching Contributions under the Plan; provided, however, that if such former Participant (or Beneficiary) subsequently files a claim for benefits with the Plan Administrator or Amoco with respect to his Account balances under the Plan, his Accounts shall be restored to the value previously forfeited (and without interest) from such Accounts.

Any written notice or other communication that is not sent in conformity with the foregoing provisions shall nevertheless be effective on the date actually received by the noticed party. Any notice received by Borrower Agent shall be deemed received by all Borrowers.
