Common use of Customer Acknowledgments Clause in Contracts

Customer Acknowledgments. (a) Your personal safety is a paramount consideration for EnergyAustralia. You must ensure that you consider your own personal safety and those in your care before responding to a Demand Response Request under this Contract. You should not participate where any resulting energy reduction will result in discomfort or injury sustained by yourself or those in your care. (b) You acknowledge that: (i) EnergyAustralia has provided you with access to a copy of, and you understand, the PowerResponse FAQs; (ii) EnergyAustralia has explained to you, and you understand, how the applicable Demand Response Product works, including the circumstances, times and duration of any electricity supply interruptions to your Premises during the Term; (iii) EnergyAustralia has explained to you, and you understand, the need for you to consider your own specific health and safety requirements, and those of any other occupant of the Premises; (iv) you have considered and are satisfied that any electricity supply interruptions that may result from a Demand Response Request under this Contract will not adversely affect your health or safety, or that of any other occupant of the Premises, including persons under your care; and (v) you have read and understood the Product Schedule (provided with these Terms and Conditions) including any additional acknowledgements made by you under the Product Schedule. (c) You acknowledge and agree that you have not, and will not during the Term of this Contract participate in any other demand response program (whether or not it is the same or similar to this Demand Response Product) offered by us or a third party in relation to the Premises without our prior written consent.

(b) 3.2 You acknowledge that: (ia) you will have agreed to these terms and conditions if you do not unsubscribe from the demand response product, and you participate in a Demand Response Event and accept a Demand Response Payment credited to your bill; (b) EnergyAustralia has provided you with access to a copy of, and you understand, the PowerResponse Demand Response FAQs; (iic) EnergyAustralia has explained to you, and you understand, how the applicable Demand Response Product demand response product works, including the circumstances, times and duration of any electricity supply interruptions to your Premises during the Termwhile this Contract is in effect; (iiid) EnergyAustralia has explained to you, and you understand, the need for you to consider your own specific health and safety requirements, and those of any other occupant of the Premises; (ive) you have considered and are satisfied that any electricity supply interruptions that may result from a Demand Response Request under this Contract will not adversely affect your health or safety, or that of any other occupant of the Premises, including persons under your care; and (vf) as the frequency of Demand Response Events will depend upon factors outside EnergyAustralia’s control (including the weather and directions from relevant regulators), EnergyAustralia is not obliged to send you have read and understood the Product Schedule (provided with these Terms and Conditions) including any additional acknowledgements made by you Demand Response Requests under the Product Schedulethis Contract. (c) 3.3 You acknowledge and agree that you have notare not currently participating, and will not during the Term of while this Contract participate remains in force participate, in any other demand response program (whether or not it is the same or similar to this Demand Response Productdemand response product) offered by us or a third party in relation to the Premises without our prior written consent.

You consent to receiving notifications which do not include an unsubscribe facility and acknowledge that we have informed you of the methods for opting out of individual events (where applicable) or the Demand Response Product more generally; and (vf) as the frequency of Demand Response Events will depend upon factors outside EnergyAustralia's control (including the weather and directions from relevant regulators), EnergyAustralia is not obliged to send you have read and understood the Product Schedule (provided with these Terms and Conditions) including any additional acknowledgements made by you Demand Response Requests under the Product Schedulethis Contract. (b) You acknowledge that: (i) EnergyAustralia has you are taking part in a trial and that elements of the Demand Response Product may change as a result of testing; we have provided you with access to a copy of, and you understand, the PowerResponse FAQsDemand Response Product FAQs available at xxxxx://xxx.xxxxxxxxxxxxxxx.xxx.xx/xxxx/xxxx-xxx- support/faqs/powerresponse-premium (ii) ; (iiiii) EnergyAustralia has we have explained to you, and you understand, how the applicable Demand Response Product works, including how you will receive communication regarding the circumstances, times and duration of any electricity supply interruptions to your Premises during the TermDemand Response Events; (iiiiv) EnergyAustralia has we have explained to you, and you understand, the need for you to consider your own specific health and safety requirements, and those of any other occupant of the Premises;; and (ivv) you have considered and are satisfied that any reduction in electricity supply interruptions usage that may result from responding to a Demand Response Request under this Contract will not adversely affect your health or safety, or that of any other occupant of person in the Premises, including persons under your care; and (v) you have read and understood the Product Schedule (provided with these Terms and Conditions) including any additional acknowledgements made by you under the Product Schedule. (c) You acknowledge and agree that you have not, and will not during the Term of this Contract participate in any other demand response program (whether or not it is the same or similar to this Demand Response Product) offered by us or a third party in relation to the Premises without our prior written consent.
