Customer Relations. Except as set forth on Schedule 3.24, there exists no actual or, to the knowledge of any Borrower, threatened termination or cancellation of, or any material adverse modification or change in the business relationship of any Borrower or any Subsidiary of any Borrower with any customer or group of customers which would reasonably be expected to result, either individually or in the aggregate, in a Material Adverse Effect.
Customer Relations. (a) The Union and the Employer agree that in view of the great number of contacts with the public in the store system, and the continuing nature of these throughout the year, the matter of courtesy in customer relations is of prime importance. (b) Where a store employee experiences difficulty with, or receives a complaint from a customer, in the course of their duties they will attempt to satisfactorily resolve the matter. In the event that the employees' attempts in this regard are unsuccessful, they will immediately summon the supervisor in charge, who will handle the matter in the manner provided for by Branch policy. (c) Where a customer complaint against a staff member is not resolved under paragraph (b) above, the Employer agrees not to take punitive action against an employee as a result of an unsigned complaint.
Customer RelationsExcept to the extent City may choose from time to time to vary from this procedure, Manager shall receive and handle all communications from customers and all others regarding Parking Enforcement operations. To the extent a communication relates to a matter solely in the discretion or authority of City, such as the amount of Parking Rates set by the City, Manager shall direct the person to City.
Customer Relations. (a) With respect to customer complaints relating to the Promotion or distribution of the Product, each Party shall act promptly to remedy such complaints. All Product-related inquiries and Product complaints in the U.S. Territory shall be addressed by SuperGen, and all Product-related inquiries and Product complaints in the International Territory shall be addressed by Xxxxxx. Each Party shall keep the other Party fully and promptly apprised of its receipt of any such significant complaints in the Territories, and provide reasonable cooperation and assistance in dealing with customer complaints in the Territories, the verifiable out-of-pocket cost of such cooperation and assistance being borne by SuperGen in the U.S. Territory and by Xxxxxx in the International Territory. (b) Any Product warranty to the customers of Xxxxxx and SuperGen shall run directly from SuperGen to such customers, notwithstanding the fact that Xxxxxx'x customers may return Product to Xxxxxx and not to SuperGen. Xxxxxx shall not make any warranty or representation to any customers which is more protective of such customers than the warranties and/ or representations provided by SuperGen. For purposes of clarification, the sole remedy of Xxxxxx and/ or SuperGen customers in the case of defective Product shall be that the Party which sold the defective Product to the customer shall replace such returned defective Product. SuperGen's Product warranties shall not apply to Product that has been modified CONFIDENTIAL TREATMENT REQUESTED or altered in any manner by anyone other than SuperGen or Xxxxxx (or their respective Affiliates or subdistributors or sublicensees), or to defects caused (i) through no fault of SuperGen SuperGen or Xxxxxx (or their respective Affiliates or subdistributors or sublicensees), during shipment, (ii) by negligence or misuse on the part of anyone other than SuperGen or Xxxxxx (or their respective Affiliates or subdistributors or sublicensees) or (iii) by storage, handling, or usage in any manner inconsistent with the approved Product labeling. (c) Neither Party shall represent the Product in any manner which is inconsistent with the approved Product labeling or with applicable laws and regulations, or otherwise misrepresent the Product.
Customer Relations. 3.1 Drivers must be courteous and pleasant to customers at all times. 3.2 Drivers must assist all customers with handling of baggage and opening and closing of doors when necessary. 3.3 No complaining to customers about short fares or time calls. 3.4 As per City of Ottawa By-Law #320-78 smoking is not permitted in taxicab by driver when requested by customer. Driver not wishing customer to smoke must post proper signage inside their taxicabs as required by City of Ottawa By-Law. 3.5 At customer request music radio and other sound system must be turned off. 3.6 Drivers must issue a receipt card upon request by customer. Drivers signature and car # must be clearly marked in the appropriate place on the receipt card.
Customer Relations. Except as set forth in Annex 30 to this Schedule 2, as of the Effective Date, there exists no actual or, to the knowledge of Tensar Holdings or Tensar, threatened termination or cancellation of, or any material adverse modification or change in, the business relationship of any Tensar Party with (i) any customer whose purchases during the preceding 12 months caused them to be ranked among the five largest customers of the Tensar Parties, taken as a whole or (ii) the counterparties to the Contech Agreement.
