Damage or Destruction by Fire Eminent Domain or Casualty. In the event that the Premises or any part thereof shall be taken by eminent domain or shall be so damaged or destroyed by fire or unavoidable casualty, that the Premises are thereby rendered untenantable, then either Landlord or Tenant may terminate this Sublease upon written notice to the other and the rent shall be prorated as of the date of such termination.
Damage or Destruction by Fire Eminent Domain or Casualty. In the event that the Leased Premises or any part thereof shall be taken by eminent domain or shall be so damaged or destroyed by fire or unavoidable casualty that the Leased Premises are thereby rendered wholly or partially un-tenantable, then Landlord may terminate this Lease upon written notice to the Tenant and the rent shall be prorated as of the date of such termination. All insurance proceeds payable as a result of such damage or destruction to and all Eminent Domain proceeds awarded by virtue of a taking of the Leased Premises shall be the sole property of the Landlord. If Landlord does not so elect, then there shall be an appropriate abatement of rent, and Landlord shall have a reasonable period of time, not to exceed one hundred and twenty (120) days from the date of such casualty in which to restore the Premises. Landlord’s obligation to restore the Leased Premises shall be limited to the amount of proceeds received from insurance policies or eminent domain awards.
