Common use of Data Protection and Security Clause in Contracts

Data Protection and Security. 3.1 Customer is solely responsible for ensuring that the Service Offering and its security is appropriate for Customer’s Content and Customer’s intended use. 3.2 Customer is responsible for taking and maintaining appropriate steps to protect the confidentiality, integrity, and security of Customer’s Content. Those steps include (a) controlling access Customer provides to Customer’s Users, (b) configuring the Service Offering appropriately, (c) ensuring the security of Customer’s Content while it is in transit to and from the Service Offering, (d) using encryption technology to protect Customer’s Content, and (e) backing up Customer’s Content. 3.3 Customer is responsible for providing any necessary notices to Users and obtaining any legally required consents from Users regarding their use of the Service Offering.
