Common use of Day Performers Clause in Contracts

Day Performers. Employer may terminate the services of Day Performers without further liability, except for compensation for services previously rendered provided, however, that: (i) if termination occurs before the Performer is used or (ii) if the Performer is subsequently replaced (other than because of their unavailability), the Performer shall be entitled to one day’s salary in addition to compensation for services previously rendered. When production is resumed after such termination, Employer may recall the Performer at the same rate and without compensation for intervening time, subject to the Performer’s professional availability.
