Deadline - defence. The organisation complained against shall as soon as possible, and no later than 20 working days before the hearing submit to the complaining organisation and the chairman of the court its defence accompanied by copies of the documents to be produced. The defence shall be deemed to have been received in time if it is received by the complaining organisation by 16:00 no later than 19 full working days – excluding Saturdays - before the hearing. If an organisation claims delay with the defence in industrial arbitration, this must be notified to the opposing party as soon as possible and no later than by 16:00 on the due date, and another deadline may be agreed upon. If the defence is not received in time, the matter shall be settled based on the information stated in the complaint and the records of the proceedings. A reply and a rejoinder may be exchanged and, in that case, shall have been received by the opposing party no later than 16:00 14 and 11 full working days, respectively, excluding Saturdays before the hearing. If one of the organisations wishes to carry out questioning, the complaint or defence must state whom the organisation wishes to question. If material appears at the hearing that one of the parties wants to present despite protest, the chairman of the court decides whether or not the material shall be included in the assessment of the case.

  • Deadline Date The parties agree to enter into collective negotiation over a successor Agreement in accordance with Chapter 123, Public Laws of 1974 in good-faith effort to reach agreement on all matters concerning the terms and conditions of employee’s employment.   • Submitting False Claims The full text of San Francisco Administrative Code Chapter 21, Section 21.35, including the enforcement and penalty provisions, is incorporated into this Agreement. Pursuant to San Francisco Administrative Code §21.35, any contractor or subcontractor who submits a false claim shall be liable to the City for the statutory penalties set forth in that section. A contractor or subcontractor will be deemed to have submitted a false claim to the City if the contractor or subcontractor: (a) knowingly presents or causes to be presented to an officer or employee of the City a false claim or request for payment or approval;

  • Objections to Settlement 7.7.1 Only Participating Class Members may object to the class action components of the Settlement and/or this Agreement, including contesting the fairness of the Settlement, and/or amounts requested for the Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment and/or Class Representative Service Payment.

  • Extended Reporting Period If any required insurance coverage is on a claims-made basis (rather than occurrence), Contractor shall maintain such coverage for a period of no less than three (3) years following expiration or termination of the Master Contract.

  • Technical Objections to Grievance No grievance will be defeated or denied by any minor technical objection.
