Death After Reaching Earliest Retirement Age. Unless an optional form of benefit has been selected within the Election Period pursuant to a Qualified Election, if a Participant dies after the Earliest Retirement Age, the Participant's Surviving Spouse, if any, will receive the same benefit that would be payable if the Participant had retired with an immediate Qualified Joint and Survivor Annuity on the day before the Participant's date of death, having selected an annuity for the life of the Participant with a survivorship annuity for the life of the Spouse which is equal to 50% of the amount of the annuity which is payable during the joint lives of the Participant and the Spouse and which the actuarially equivalent of the normal form of benefit, or if greater, any optional form of benefit. The surviving Spouse may elect to commence payment under such annuity within a reasonable period after the Participant’s death. The actuarial value of benefits, which commence later than the date on which payments would have been made to the surviving Spouse under a Qualified Joint and Survivor Annuity at Normal Retirement Age in accordance with this provision, shall be adjusted to reflect actuarial reductions for earlier benefit payments or actuarial increases for benefits commencing after Normal Retirement Age. For applications with benefit commencement dates on and after September 25, 2013, the sections of the Plan dealing with the subsidized joint and survivor annuity payments have been suspended.

  • Re-employment After Retirement Employees who have reached retirement age as prescribed under the Pension (Municipal) Act and continue in the Employer's service, or are re-engaged within three (3) calendar months of retirement, shall continue at their former increment step in the pay rate structure of the classification in which they are employed, and the employee's previous anniversary date shall be maintained.
