Debarment, Suspension, and Other Responsibility Matters. ‌‌ A. The Contractor certifies to the best of its knowledge and belief, that it and its subcontractors: 1. Are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency; 2. Have not within a three-year period preceding this Agreement been convicted of or had a civil judgment rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property; 3. Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal, State, or local) with commission of any of the offenses enumerated in paragraph (A)(1) of this section; 4. Have not within a three-year period preceding this Agreement had one or more public transactions (Federal, State, or local) terminated for cause or default; and 5. Contractor shall report immediately to the Department in writing any incidents of alleged fraud and/or abuse by either Contractor or Contractor’s subcontractor. Contractor shall maintain any records, documents, or other evidence of fraud and abuse until otherwise notified by the Department. B. The Contractor agrees to timely execute any and all amendments to this Agreement or other required documentation relating to their subcontractors’ debarment/suspension status.

The Contractor shall report immediately to the Department Agency on Aging, in writing writing, any incidents of alleged fraud and/or abuse by either the Contractor or Contractor’s subcontractorsubcontractors. The Contractor shall maintain any records, documents, or other evidence of fraud and abuse until otherwise notified by the DepartmentAgency on Aging. B. 3. The Contractor agrees to timely execute any and all amendments to this Agreement or other required documentation relating to their subcontractors’ the Subcontractor’s debarment/suspension status. 4. The Contractor shall notify the Agency on Aging immediately of any intention to discontinue existence of the entity or to bring an action for dissolution.
