Debt Service Shortfall. On the thirtieth (30th) day prior to any Record Date (as defined in the Bond Indenture), or, if such date is not a business day, on the next succeeding business day, the Trustee shall calculate the amount of the related interest and/or principal payment (the “Debt Service Payment”) and shall compare such Debt Service Payment to the amounts on deposit and available for payment thereof (the “Available Funds”). If the Available Funds, together with the scheduled estimated monthly installment of Contingent Rent under this Agreement and the other Agreements, is insufficient to pay the Debt Service Payment in full, the Trustee shall provide RAC a statement indicating (i) the total amount of such principal or interest payment, (ii) the total CFC collections received by the Trustee or the Department, as the case may be, and attributable to such period, and (iii) the available balance of the CFC Revenue Fund for such period (the “Debt Service Deficiency Statement”). Upon receipt of a Debt Service Deficiency Statement, RAC shall pay to Trustee, promptly, but in no event more than 10 days after the Trustee sends the Debt Service Deficiency Statement, RAC’s Proportionate Share of any deficiency in Available Funds when compared to the forthcoming Debt Service Payment (a “Debt Service Deficiency Payment”). In the event that a rental car concessionaire fails to make a Debt Service Deficiency Payment within the time period provided above, and the amount of such failure exceeds the amount available to the State under the performance deposit of such concessionaire, State shall provide notice of such underpayment to RAC and all other On-Airport Rental Car Companies and Off- Airport Rental Car Companies and RAC and all other On-Airport Rental Car Companies and Off-Airport Rental Car Companies shall be jointly and severally liable for such amount, which shall be due and payable ten days after notice of such failure. Such sums shall be deemed additional rent hereunder.

  • Debt Service Coverage Ratio Borrower shall maintain as of the last day of any fiscal quarter a Debt Service Coverage Ratio of not less than 1.25 to 1.00 for the period of four consecutive fiscal quarters then ended on such day.

  • Finance Charge Each Receivable provides for the payment of a finance charge or shall yield interest calculated on the basis of an APR ranging from 0.50% to 22.05%.

  • Available Funds-Contingency-Termination a. The State is prohibited by law from making commitments beyond the term of the current State Fiscal Year. Payment to Local Agency beyond the current State Fiscal Year is contingent on the appropriation and continuing availability of Agreement Funds in any subsequent year (as provided in the Colorado Special Provisions). If federal funds or funds from any other non-State funds constitute all or some of the Agreement Funds, the State’s obligation to pay Local Agency shall be contingent upon such non-State funding continuing to be made available for payment. Payments to be made pursuant to this Agreement shall be made only from Agreement Funds, and the State’s liability for such payments shall be limited to the amount remaining of such Agreement Funds. If State, federal or other funds are not appropriated, or otherwise become unavailable to fund this Agreement, the State may, upon written notice, terminate this Agreement, in whole or in part, without incurring further liability. The State shall, however, remain obligated to pay for Services and Goods that are delivered and accepted prior to the effective date of notice of termination, and this termination shall otherwise be treated as if this Agreement were terminated in the public interest as described in §2.C.

  • Minimum Interest Charge If the interest charge for all balances on your Credit Card account is less than $1.00, we will charge you the Minimum Interest Charge shown on page 1. This charge is in lieu of any interest charge.

This gives us the daily balance. Then, we add up all the daily balances for the billing cycle and divide that by the number of days in the billing cycle.   • Average Contribution Amount For purposes of this Agreement, to ensure that all employees enrolled in health insurance through the City’s HSS are making premium contributions under the Percentage-Based Contribution Model, and therefore have a stake in controlling the long term growth in health insurance costs, it is agreed that, to the extent the City's health insurance premium contribution under the Percentage-Based Contribution Model is less than the “average contribution,” as established under Charter section A8.428(b), then, in addition to the City’s contribution, payments toward the balance of the health insurance premium under the Percentage-Based Contribution Model shall be deemed to apply to the annual “average contribution.” The parties intend that the City’s contribution toward employee health insurance premiums will not exceed the amount established under the Percentage-Based Contribution Model.
