DECLARATION OF FINDING Clause Samples
A Declaration of Finding clause formally states the conclusions or determinations reached by one or both parties regarding specific facts or circumstances relevant to the agreement. This clause typically outlines the factual background or key findings that form the basis for entering into the contract, such as confirming the existence of certain conditions or compliance with regulatory requirements. Its core practical function is to establish a shared understanding of essential facts, thereby reducing the risk of future disputes over the underlying assumptions or context of the agreement.
DECLARATION OF FINDING. 1. The Regional Body shall meet to consider a Proposal. The Applicant shall be provided with an opportunity to present the Proposal to the Regional Body at such time.
2. The Regional Body, having considered the notice, the Originating Party’s Technical Review, any other independent Technical Review that is made, any comments or objections including the analysis of comments made by the public, First Nations and federally recognized Tribes, and any other information that is provided under this Agreement shall issue a Declaration of Finding that the Proposal under consideration:
a. Meets the Exception Standard;
b. Does not meet the Exception Standard; or,
c. Would meet the Exception Standard if certain conditions were met.
3. An Originating Party may decline to participate in a Declaration of Finding made by the Regional Body.
4. The Parties recognize and affirm that it is preferable for all members of the Regional Body to agree whether the Proposal meets the Exception Standard.
5. If the members of the Regional Body who participate in the Declaration of Finding all agree, they shall issue a written Declaration of Finding with consensus.
6. In the event that the members cannot agree, the Regional Body shall make every reasonable effort to achieve consensus within 25 days.
7. Should consensus not be achieved, the Regional Body may issue a Declaration of Finding that presents different points of view and indicates each Party’s conclusions.
8. The Regional Body shall release the Declarations of Finding to the public.
9. The Originating Party shall consider the Declaration of Finding before it makes a decision on the Proposal.

i. Meets the Standard of Review and Decision; ii. Does not meet the Standard of Review and Decision; or,
DECLARATION OF FINDING. Upon review of the submissions of the Province of Ontario and the terms of the Agreement, the Regional Body finds that:
A. Based on the report submitted by the Province of Ontario, the Water Management Program presented by the Province of Ontario meets or exceeds the current requirements of the Agreement.
B. Based on the report submitted by the Province of Ontario, the Water Conservation and Efficiency Program presented by the Province of Ontario meets or exceeds the current requirements the Agreement. January 8, 2015 The following information is submitted by the Province of Ontario to the Great Lakes Regional Body Secretariat in response to the Questionnaire for Preliminary Submittals by States and Provinces, in fulfillment of the five-year review of Ontario’s Water Management Programs, pursuant to the requirements in Article 300 of the Great Lakes-St. ▇▇▇▇▇▇▇▇ River Basin Sustainable Water Resources Agreement (Agreement).
DECLARATION OF FINDING. Upon review of the submissions of the Government of Québec and the terms of the Agreement, the Regional Body finds that:
A. Based on the report submitted by the Government of Québec, the Water Management Program presented by the Government of Québec meets or exceeds the current requirements of the Agreement.
B. Based on the report submitted by the Government of Québec, the Water Conservation and Efficiency Program presented by the Government of Québec meets or exceeds the current requirements the Agreement. This Questionnaire is provided as a guide to assist the States and Provinces in gathering the information necessary to prepare their Five-Year Reports and to enable the Compact Council and Regional Body to undertake their required review, declaration of findings and recommendations under the Compact and the Agreement.
