Deemed Effective Date of Sixth Amendment. Seller and Purchaser acknowledge that in the event this Sixth Amendment is executed by a party or the parties subsequent to April 29, 2022; both Seller and Purchaser agree and covenant that the Effective Date of this Sixth Amendment shall, under all circumstances, be deemed to be and shall relate back to April 29, 2022. Seller and Purchaser further agree and covenant that under no circumstances whatsoever shall the signature dates of a party or the parties to this Sixth Amendment constitute a lapse of the Purchase Agreement.
