Deemed Notice. A notice or other communication is deemed given if: (a) personally delivered, upon delivery; (b) mailed to an address in Australia, on actual delivery to the addressee, as evidenced by Australia Post documentation; (c) sent by facsimile (and is other than a notice of termination or suspension of this entire agreement), on the next Business Day after being sent if following transmission the sender receives a transmission confirmation report or if the sender’s machine is not so equipped to issue a transmission confirmation report then upon the sender receiving acknowledgment of receipt; or (d) sent by email, 2 hours after the sent time (as recorded on the sender’s email server) unless the sender receives a notice from the recipient’s email server that the message has not been delivered to the recipient.
