DEFAULTING PRODUCERS. Any Producer engaging any Actor represents that such Producer is not in default under any agreement with Equity at the time of such engagement and that no contract has been entered into between said Producer and Equity or any Actor, any breach of which remains unsettled or unliquidated. No Actor shall work or be required by any Producer, without the consent of Equity, to work for any person, co-partnership, corporation, enterprise or group which has failed to abide by any arbitration award or, where permitted herein, any final determination of the Equity Council, or which, through failure to meet past obligations to Equity, has been placed on Equity's Defaulting Producers list, nor shall any Actor work for or be employed by anyone who is or has been connected, either as an individual proprietor, general partner, associate producer, corporate director or officer or active stockholder with any defaulting Producer so specified, without the consent of Equity.

DEFAULTING PRODUCERS. (1) If a Producer defaults or pays salaries out of the bond, before being permitted to again produce under Equity's jurisdiction, said Producer shall replace the amount deducted from the bond as a result of such default or payment of salaries and post an additional amount equivalent to the original bond. Each time a Producer defaults or pays salaries out of the bond, the amount of the existing bond shall be doubled.

  • Dedicated Transport A DS0-, DS1-, or DS3-capacity transmission facility between Verizon switches (as identified in the LERG) or UNE Wire Centers, within a LATA, that is dedicated to a particular end user or carrier. Dedicated Transport is sometimes referred to as dedicated interoffice facilities ("IOF"). Dedicated Transport does not include any facility that does not connect a pair of Verizon UNE Wire Centers.

  • SOURCE CODE ESCROW FOR LICENSED PRODUCT If Source Code or Source Code escrow is offered by either Contractor or Product manufacturer or developer to any other commercial customers, Contractor shall either: (i) provide Licensee with the Source Code for the Product; or (ii) place the Source Code in a third party escrow arrangement with a designated escrow agent who shall be named and identified to the State, and who shall be directed to release the deposited Source Code in accordance with a standard escrow agreement acceptable to the State; or (iii) will certify to the State that the Product manufacturer/developer has named the State, acting by and through the Authorized User, and the Licensee, as a named beneficiary of an established escrow arrangement with its designated escrow agent who shall be named and identified to the State and Licensee, and who shall be directed to release the deposited Source Code in accordance with the terms of escrow. Source Code, as well as any corrections or enhancements to such source code, shall be updated for each new release of the Product in the same manner as provided above and such updating of escrow shall be certified to the State in writing. Contractor shall identify the escrow agent upon commencement of the Contract term and shall certify annually that the escrow remains in effect in compliance with the terms of this clause. The State may release the Source Code to Licensees under this Contract who have licensed Product or obtained services, who may use such copy of the Source Code to maintain the Product.

  • Abuse, Neglect, Exploitation Grantee will;

  • Net Metering If you generate electricity from a renewable generating facility to offset your electricity consumption and/or use net metering at any time during the term of this Agreement, you must notify Starion.

  • Licensed Products Lessee will obtain no title to Licensed Products which will at all times remain the property of the owner of the Licensed Products. A license from the owner may be required and it is Lessee's responsibility to obtain any required license before the use of the Licensed Products. Lessee agrees to treat the Licensed Products as confidential information of the owner, to observe all copyright restrictions, and not to reproduce or sell the Licensed Products.
