Defects Liability Period. (i) The Contractor shall be responsible for all the Defects and deficiencies, except usual wear and tear in the Project Highway or any Section thereof, till the expiry of a period of commencing from the date of Completion Certificate (the “Defects Liability Period”) as specified below:
(a) 5 (five) years from the date of completion in case of a road being constructed with flexible pavement;
(b) 10 (ten) years from the date of completion in case of road being constructed with rigid pavement;
(c) 10 (ten) years from the date of completion in case of road being constructed with flexible pavement using perpetual design;
(d) 10 (ten) years from the date of completion in case of all stand-alone structures, e.
Defects Liability Period. Defects liability period shall start for Instructed works immediately the works are certified as Complete by the Engineer. The period of Defects liability shall be prescribed in the Appendix to the Contract. SUBCLAUSE 49.2 – COMPLETION OF OUTSTANDING WORK AND REMEDYING DEFECTS Add At the time of End of Defects Liability Inspection, no defect arising from the permanent works existing shall be acceptable for taking over. The Inspection team shall verify and satisfy themselves that all the outstanding works and defects arising out of the works have been attended to sufficiently. Routine Maintenance works/PBC Works shall also be inspected at the time of End of Defects Liability Inspection and should comply to the specifications of the PBC Works.
Defects Liability Period. 17.1.1 The Contractor shall be responsible for all the Defects and deficiencies, except usual wear and tear in the Project Highway or any Section thereof, till the expiry of a period of 4 (four) years commencing from the date of Provisional Certificate (the “Defects Liability Period”). Provided that the Defects Liability Period shall in no case be less than 42 (forty two) months from the date of Completion Certificate for and in respect of works for which Time Extension was granted. Provided further that in the event no Provisional Certificate is issued, the Defects Liability Period shall commence from the date of the Completion Certificate. For the avoidance of doubt, any repairs or restoration on account of usual wear or tear in the Project Highway or any Section thereof shall form a part of the Maintenance obligations of the Contractor as specified in Article 14.
17.1.2 Deleted.
Defects Liability Period. (a) During the Defects Liability Period, the Council (acting reasonably) may give to the Developer a notice (Rectification Notice) in writing that identifies a defect in the Works and specifies:
(i) action required to be undertaken by the Developer to rectify that defect (Rectification Works); and
(ii) the date on which the defect must be rectified (Rectification Date).
(b) The Developer must comply with the Rectification Notice by:
(i) procuring the performance of the Rectification Works by the Rectification Date, or such other date as agreed between the parties;
(ii) keeping the Council reasonably informed of the action to be taken to rectify the defect; and
(iii) carrying out the Rectification Works.
(c) The Council must give the Developer and its contractors any access required to carry out the Rectification Works.
(d) When the Developer considers that the Rectification Works are complete, either the Developer must notify the Council and provide documentation, plans or invoices which establish that the Rectification Works were carried out.
(e) The Council may inspect the Rectification Works within 15 Business Days of receiving a Notice from the Developer under clause 8.4(d) of this Schedule 2 and, acting reasonably:
(i) issue a further Rectification Notice if it is not reasonably satisfied that the Rectification Works are complete; or
(ii) notify the Developer in writing that it is satisfied the Rectification Works are complete.
(f) The Developer must meet all costs of and incidental to rectification of defects under this clause 8.4.
(g) If the Developer fail to comply with a Rectification Notice, then the Council may do such things or take such action as is necessary to carry out the Rectification Works, including accessing and occupying any part of the Land without further notice to the Developer, and may:
(i) call upon the Bank Guarantee provided to the Council under clause Error! R eference source not found. of this Schedule 2 to meet its costs of carrying out Rectification Works; and
(ii) recover as a debt due to the Council by the Developer in a court of competent jurisdiction, any difference between the amount of the security deposit and the costs incurred by the Council in carrying out Rectification Works.
(h) The Developer must request that Council inspect the Works 28 days prior to the end of the Defects Liability Period. The Council must inspect the Works at any time after receiving the request from the Developer and before to the end of the...
Defects Liability Period. Defects Liability Period. The Defects Liability Period shall cover a period of 12 (twelve) months. If the Supplier has offered a longer Defects Liability Period (warranty) on specific items, this shall apply. However, for the Defects Liability Period the Supplier's warranty must as a minimum comply with the requirements in the Agreement. The Defects Liability Period shall be extended in case of Delivery of defective Delivery Items (both Defects and System Defects), so that a new Defects Liability Period (but not a new System Defects Liability Period) begins for the Delivery Items in question when they have been delivered without Defects.
Defects Liability Period. The Contractor shall be responsible to make good and remedy at his own expense within such period as may be stipulated by the Engineer-in-charge, any defect which may develop or may be noticed before the expiry of the period hereto from the certified date of completion and intimation of which has been sent to the Contractor within seven days of the expiry of the said period by a letter sent by hand delivery or by registered post.

The expression "Defects Liability Period" shall mean the period of twelve (12) months, calculated from the date of completion of the Works stated in the Certificate of Substantial Completion issued by the Engineer or, in respect of any Section or part of the Works for which a separate Certificate of Substantial Completion has been issued, from the date of completion of that Section or part as stated in the relevant Certificate. The expression "the Works" shall, in respect of the Defects Liability Period, be construed accordingly.

15.1.2 Without prejudice to the provisions of Clause 15.1.1, the Defects Liability Period for and in respect of any Structure or MEP or HVACequipment comprising a new technology as specified in Schedule B, shall be deemed to be extended by a further period of 2 (two) year after the expiry of the Defects Liability Period specified in Clause 15.1.

15.1.3 Without prejudice to the provisions of Clause 15.1.1, the Contractor shall be responsible for making arrangement for signing of agreement for AMC of SCADA as per clause 3.9 of Annexure - I (Schedule-B) between OEM/Approved SCADA vendor and concerned Railway/Division 6 months prior to defects liability period as defined in 15.1.
