Common use of DELAY OUTSIDE BONDOWNER REPRESENTATIVE’S CONTROL Clause in Contracts

DELAY OUTSIDE BONDOWNER REPRESENTATIVE’S CONTROL. Bondowner Representative shall not be liable in any way to Borrower or any third party for Bondowner Representative’s failure to perform or delay in performing under the Loan Documents (and Bondowner Representative may suspend or terminate all or any portion of Bondowner Representative’s obligations under the Loan Documents) if such failure to perform or delay in performing results directly or indirectly from, or is based upon, the action, inaction, or purported action, of any governmental or local authority, or because of war, rebellion, insurrection, strike, lock out, boycott or blockade (whether presently in effect, announced or in the sole judgment of Bondowner Representative deemed probable), or from any Act of God or other cause or event beyond Bondowner Representative’s control.
