DELEGATIONS OF AUTHORITY. The HMO shall oversee and remain accountable for any functions and responsibilities that it delegates to any subcontractor. For all major or minor delegation of function or authority: ⮚ There shall be a written agreement that specifies the delegated activities and reporting responsibilities of the subcontractor and provides for revocation of the delegation or imposition of other sanctions if the subcontractor’s performance is inadequate, or out of compliance with HIPAA privacy or security requirements. ⮚ Before any delegation, the HMO shall evaluate the prospective subcontractor’s ability to perform the activities to be delegated. ⮚ The HMO shall monitor the subcontractor’s performance on an ongoing basis and subject the subcontractor to formal review at least once a year. ⮚ If the HMO identifies deficiencies or areas for improvement, the HMO and the subcontractor shall take corrective action. ⮚ If the HMO delegates selection of providers to another entity, the HMO retains the right to approve, suspend, or terminate any provider selected by that entity.
