Common use of Delivery of Information Clause in Contracts

Delivery of Information. Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower or any other Person under or in connection with any Loan Instruments except (i) as specifically provided in the Loan Instruments or (ii) as specifically requested from time to time in writing by any Lender with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.

Delivery of Information. Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reportsagreements, notices, communications or other information received by Agent from Borrower Borrowers, the Required Lenders, any Lender or any other Person under or in connection with this Agreement or any Loan Instruments other Credit Document except (ia) as specifically provided in the Loan Instruments this Agreement or any other Credit Document and (iib) as specifically requested from time to time in writing by any Lender with respect to a specific documentdocuments, instrumentinstruments, notice notices or other written communication communications from Borrowers received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific requestAgent.

Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower Borrower, the Required Lenders, any Lender or any other Person under or in connection with this Agreement or any Loan Instruments other Related Document except (i) as specifically provided in the Loan Instruments this Agreement or any other Related Document and (ii) as specifically requested from time to time in writing by any Lender with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.

Delivery of Information. Agent shall not be required to deliver to any Lender or the Issuing Bank originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower the Borrowers, the Required Lenders, any Lender, the Issuing Bank or any other Person under or in connection with this Agreement or any Loan Instruments other Financing Agreement except (i) as specifically provided in the Loan Instruments this Agreement or any other Financing Agreement and (ii) as specifically requested from time to time in writing by any Lender 95 or the Issuing Bank with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.

Delivery of Information. Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower Borrower, the Required Lenders, any Lender or any other Person under or in connection with this Agreement or any Loan Instruments other Related Document 100 except (i) as specifically provided in the Loan Instruments this Agreement or any other Related Document and (ii) as specifically requested from time to time in writing by any Lender with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.

Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower the Borrowers, the Required Lenders, any Lender or any other Person under or in connection with this Agreement or any Loan Instruments other Financing Agreement except (i) as specifically provided in the Loan Instruments this Agreement or any other Financing Agreement and (ii) as specifically requested from time to time in writing by any Lender with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.

Agent shall not be required to deliver to any Lender originals or copies of any documents, instruments, reportsagreements, notices, communications or other information received by Agent from Borrower Companies, the Required Lenders, any Lender or any other Person under or in connection with this Agreement or any Loan Instruments other Transaction Document except (ia) as specifically provided in the Loan Instruments this Agreement or any other Transaction Document and (iib) as specifically requested from time to time in writing by any Lender with respect to a specific documentdocuments, instrumentinstruments, notice notices or other written communication communications from Companies received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific requestAgent.

Agent shall not be required to deliver to any Lender or any Holder originals or copies of any documents, instruments, reportsagreements, notices, communications or other information received by Agent from Borrower Borrowers or Guarantors, any Lender, any Holder or any other Person under or in connection with this Agreement or any Loan Instruments other Credit Document except (ia) as specifically provided in the Loan Instruments this Agreement or any other Credit Document and (iib) as specifically requested from time to time in writing by any Lender or any Holder with respect to a specific documentdocuments, instrumentinstruments, notice notices or other written communication communications from Borrowers received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific requestAgent.

Agent shall not be required to deliver to any Lender or the Issuing Bank originals or copies of any documents, instruments, reports, notices, communications or other information received by Agent from Borrower the Borrowers, the Required Lenders, any Lender, the Issuing Bank or any other Person under or in connection with this Agreement or any Loan Instruments other Financing Agreement except (i) as specifically provided in the Loan Instruments this Agreement or any other Financing Agreement and (ii) as specifically requested from time to time in writing by any Lender or the Issuing Bank with respect to a specific document, instrument, notice or other written communication received by and in the possession of Agent at the time of receipt of such request and then only in accordance with such specific request.
