Common use of Delivery of Property on Termination Clause in Contracts

Delivery of Property on Termination. Except as otherwise provided herein, the Custodian hereby agrees upon termination of this Agreement to deliver to or to the order of the Client all Property and copies of all books, records, documents, papers and electronic data which are in the possession of the Custodian, the Custodian’s sub-custodians and their respective agents which would reasonably be expected to be necessary in order for a successor custodian to provide custodial services relating to the Property within a timeframe that is in accordance with industry standards. In the case of Securities held in bearer form or registered in the name of a nominee, the Client hereby agrees to accept delivery of any securities of the same class and denomination in place of those delivered to or acquired by the Funds.
